probably line of sight. Baofeng's UV-5r is very popular in the HAM radio and 4x4 community.

Line of sight through a 40x scope :) I have 6 Baofeng UV-5Rs, they are the cheapest 5W dual band radio you can buy, but they perform very well provided it's not a dud out of the box. I had to return 2 that wouldn't turn on, the other 4 were fine. We use them for 4x4ing, hunting and just plain communicating around the cottage. The range is an EASY 20 km on the hwy (unobstructed line of sight) and a good 10KM in the bush, maybe more.
 
Great price for a 50cm rig. Google "CHIRP radio programming" and with a USB cord and few free downloads you can set it up for FRS frequencies or what-have-you. I just spent $100 to ship three UV-5r+ models from China. I could have had three of these and a jerry can!

You can go on the Radio Reference site and import the freq's for your area using the USB cord and CHIRP software.
 
Yes, if any frequency besides the FRS-GMRS channels are transmitted on. Listening to other's transmissions, like a railfan might, does not.
 
Are they Industry Canada certified? Early versions of these radios were not and caused dangerous RF burns.

Explain what an RF burn is? I'm an Electrical/Electronics Engineer and have never heard of this.
The only way you could get burned might be to touch a part that gets too hot.
 
I really really miss FHSS radios that use to be on the market - should have stocked up while they were available. eXRS was good :(

CanAm, do you think you may get other radio options in the future, non GMRS or FRS?
