just a question during deer season a MNR pickup drove onto property up and old shut down road. Opened the gate a my property line drove thru left gate open that is not good as I graze cattle and goats on that property and proceeded to drive thru my hay fields and eventually crossed a out of repair bridge and drove off the property.
Curious to that 2 days earlier we had 2 OPP on a side by side stop and talk to the wife of one of the hunters.
have not seen either MNR OR OPP for 15 yrs
 
Those actions may only be taken on "reasonable and probable" grounds. As the property owner, you have the right to ask what those "grounds" are. As for leaving the gate open... that is just rude, and is actionable if it causes "loss."
 
As Hoyt said, they require probable grounds to believe that someone is hunting or committing an offence on the property to enter it (unless it's public), they cannot just randomly enter and search properties looking for hunters.

I do not believe it to be harassment though. Just an individual being inconsiderate.
 
To give the benefit of the doubt, I am going to assume they had a lawful excuse, but the gate being left open is just ignorance. I'd have a chain on my gate for next time though.
 
Yup, chain it. Also depends on what authority they have in a "resort of wildlife" when it is private property. Some Wildlife Acts can take away land ownership "rights" with respect to wildlife (we don't actually have rights on a freehold). Here in NB we have no right to close our property to allow hunting by owner and invited guests only, if we hunt on the property we have to allow reasonable access to others with permission under the wildlife act.
 
Leaving the gate open is ignorant. Call their supervisors and complain. Nothing will change if we don't ever say anything.

ps - on second thought, next time you find your gate open, lock the wankers in with a 1/2" chain and a big armoured padlock......let 'em go for a bit of a walk, or call their boss for help and then they can explain why.....

If you hunt your property, you have to allow anyone that asks permission access?

I would report the actions to MNR HQ. Not all employees are stellar individuals and have sparkly clean administrative records. Telling the boss that Officer XX did what you claim, might be the ammunition the system is looking for to move this fellow along. In any case, failing to respect the landowner's livestock and fencing is always bad behaviour.

It is more like Tresspasssing....
Call your local MNR Office and get the low down as to why they where running all over your property and leaving gates open.
As for the hay field, send them a bill for the loss of the crops.
But, alas this is CGN and not much more will be done to prevent further atrocities.

You certainly have some backwards laws in NB.

In the OP's situation, I would chain and lock the gate if anyone was leaving the gate open while I had animals inside.
 
Leaving the gate open is outright ignorant not to mention dangerous. Who would be held responsible if livestock were to get onto a roadway and cause damage/injury?? I don't imagine the guilty party would step forward. Submit a complaint to help cover your arse if it ever happens again. Providing you can prove it was them who left the gate open.
 
We are getting more contact with opp and mnr up in north bay as well the last few years. Never even seen them before.

I consider this harassment.
 
Not harassment, they have a right to be there (like it or not). Leaving the gate open well yes they should close it but again I lock my gates to avoid this issue. If they are concerned something is going on they will walk around or through them.

Police and consecration officer ridicule on this site needs to stop. They have a job to do and most do it to the best of their ability day in and day out. Just this guys opinion.
