At the range today to test out my Beretta 96 mag in my 92FS today. There are a couple other guys there, so i mention what I'm about to do to the lads before having at it.

They were pretty taken aback, so I pulled out the phone and read Bulletin 72 subsection 5 to them:

5. Magazines for semiautomatic handguns which contain more than ten (10) rounds of a different calibre

Magazines designed to contain centrefire cartridges and designed or manufactured for use in a semiautomatic handgun, are limited to 10 cartridges. The capacity is measured by the kind of cartridge the magazine was designed to contain. In some cases the magazine will be capable of containing more than 10 rounds of a different caliber; however that is not relevant in the determination of the maximum permitted capacity.

Example:
Heckler and Koch P7 pistol chambered for 9mm Luger caliber:
The magazine designed for the 40 S&W calibre variant of the pistol will hold 13 cartridges of 9mm Luger calibre and function in the 9mm Luger calibre P7 pistol. This is permissible as the maximum permitted capacity of the 40 S&W calibre magazine must be measured by the number of 40 S&W calibre cartridges it is capable of holding, which is 10 such cartridges in the case of the HK P7 pistol magazine
.

The lead guy responds by saying "nowhere in there did it say it was okay to use in your pistol." So I read this part a second time:

The magazine designed for the 40 S&W calibre variant of the pistol will hold 13 cartridges of 9mm Luger calibre and function in the 9mm Luger calibre P7 pistol. This is permissible as the maximum permitted capacity of the 40 S&W calibre magazine must be measured by the number of 40 S&W calibre cartridges it is capable of holding, which is 10 such cartridges in the case of the HK P7 pistol magazine.

Once again he says "still doesn't say you can use it"

You can lead a horse to water, but ya can't make him drink.

This is the second time I have tried to inform someone of this great bit of freedom that we have, and the secomd time I have been met with resistance. They were nice guys, but afraid.

I was accused on CGN here for "looking for confrontation" when mentioning this bulletin 72. I am truly not! I just want folks to know they can do this! I feel the more that use 40mags in their 9mm the better.

Any one else use 40s&w mags in their 9mm here? Have you had similar experiences?

I was shooting my Shadow with an IWI 40 cal mag at the range one day and after firing 14 rounds, I starting reloading. The guy beside me looks at me and says "40 cal mag?" I say yup, he smiles and nods and goes back to what he was doing. Guess he was just making sure it wasn't a high-cap 9mm mag I was using.

Absolutely legal. Good posts......

Aaahhhh that was refreshing! No joke! Like a glass of cool water. Thank you so much for the post

Sheeple... What part of the word permissible didn't they get? Some people don't want to let themselves hear the truth i guess.

I've never had a problem when using .40s&w mags in my 9mm but I don't warn anyone I'm going to be shooting more than 10 rounds, if they're swift enough to notice and are curious enough to ask I'll explains it to them. Or maybe they'll just mind their own buisness, like I do when I'm at the range lol.

Sadly a large segment, probably a large majority, of people believe that a law must be passed to make something legal. And ergo, and that the default state of everything unknown is illegal.

The word Sheeple did come to mind...

I only mentioned it to them as we live in a small community and everyone is chatty. So it would have been rude to just set up shop without saying anything and start blastin'

And I am kind of on a crusade to get more 40 mags in 9mm pistols... so will bring it up any chance I get :)

It takes me the same amount of time to go through a mag whether it's got 5 in it, or 30. I use 9mm mags as a cost saving measure. Hell, I've been thinking about using 9mm mags in my .40.

I tend to follow a rule of thumb that if a law has not been passed to make it illegal, by default, it is legal. They may not have said we could do something but they didnt say we couldnt so it either, and until they do, carry on as if you were normal...lol

I went to the range with my JR Carbine in .40 s&w, had a few 10 round glock mags with me. After we were done shooting rifles, we went to the handgun bay, and started shooting my buddy's glock 17. He only had one mag with it, so I suggested we use my .40 mags. My buddies didn't know they would feed 9mm, and also learned that you can legally stuff a few extra rounds of 9mm in them.

He has presumably bought some glock 22 mags by now :)

You guys are crazy and flirting with disaster. It's always the 11th cartridge that randomly zips off to unknown destinations and hits children, puppies, and kittens. That's why the government brought in the "10 only" laws. It's for the sake of the children......

Simple, shoot 10 then rack slide to eject #11, continue shooting the remaining rounds, disaster averted.
