Just a quick question to settle an argument, does the game warden in Ontario have the right to go onto private property to investigate hunters to make sure they are not poaching or hunting according to the regulations? Or is he considered as a tresspasser and needs to get permission before he goes onto private land?

Conservation Officers
Conservation Officers have powers of inspection, arrest, search and seizure under the various statutes they enforce, including the Fish and Wildlife Conservation Act and the Fisheries Act. When carrying out their duties Conservation Officers may do the following:

-Stop and inspect a vehicle, boat or aircraft
-Ask questions relevant to the inspection
-Enter onto private property in the discharge of their duties
-Inspect buildings or other places
-Search with a warrant
-Search without a warrant in circumstances requiring immediate action
-Require the assistance of persons to complete an inspection of coolers and containers
-Seize items related to an offence
-Arrest anyone the Conservation Officer believes has committed, is committing, or is about to commit an offence.

Police Officers appointed under the Police Services Act, RCMP Officers, National Wildlife Officers, National Park Wardens and Conservation Officers of all border states and provinces are designated Conservation Officers in Ontario.

you beat me by a minute

good luck and let us know the guys reaction....

dont sugar coat it to him and make sure you build it up before dropping the ball on him...:sniper:

Grouseman, I can't win with this guy, I gave up, I told him the proof of what the law is and I even showed him on the government website, the clause, and he just turned around and told me that its not true and it just writes that just to scare people from doing wrong, and if I believe what it writes I am stupid.
He then told me he knows its bull because last year in the Ottawa area there was an article in all the papers where a warden was prosecuted for going onto private land and was fired and fined and the ministry didnt back him up.
Probably made up cause I dont buy it.

Never heard of that, and I'm sure a story like that would have made the rounds. I actually know a couple CO's and a provincial park superintendant and they all have more authority than OPP when it comes to things like seach and seizure.

i have the same thing with a couple of the guys in my hunt camp.i'm sure a lot of this got started many moons ago in a hunt camp, when some "old , wise hunter" told him or somebody he knows, all about co's rights to search and sieze and that's that.my guys are the same way, except they won't even look at it in the regs because they're so damn bull headed. one of our guys was told by his great uncle, that black bear season, WMU63A always runs the same as deer season!!! i.e. nov 5 to nov.18 . thats it , end of discussion!. his great uncle , accordig to this guy knew everything about hunting, so the fish and wildlife conservation act is a pile of sh!t.
