is it illegal to spot light deers?

ok. last night i went spot lighting deers , and want to know if this is legal or illegal

ok. last night at 4am after cruise night, we had a big big deer run out infront of the car, well we missed it DAM i wanted some spring deer meat. (jk...) well i had my flashlight on me , (ok maybe not a little flashlight but a 700lm spotlight) so i turned it on and looked into the bush/field and omg there where like 30 deer. and they where laying down. so i pulled out my cam. (had it on me seeing it was cruise night.) and snaped some pics of them. (this was outside of the city) no guns in the car this night (pulled them out seeing it was cruise night and cops pull you over all the time.) also they started to "walk into the light!" then we drove away when they got maybe 10ft from the car. (dum deer!)

well is it legal or illegal to do this seeing we had no guns.
i think it is illegal what do you think?

Depends. If you are just taking a quick glance, most LEO's wouldn't care. But there is a fine line where it becomes harassment of wildlife, which is illegal.

we where there for maybe 2-3 min then we left. and for the pics most of them are black and you cannot see them.

i told my dad that this is illegal so lets get out of hear. but i have to say it was cool seeing all the green eyes
 
From one of your previous posts, I don't think you dad is the best person to answer this question!

i am trying to prove a point to him seeing he is a little "nutz". ok maybe a little more then a little , i dont even see how he is able to buy guns or still hunt. (i dont hunt with him no more. seeing i dont trust him no more...

Here in quebec you would be accused of presumption of poaching. Here is a story that serves as an exemple.
A lady all dressed up fit to take to the ball, is driving in her BMW convertible and is shinning a spot light in every field looking for deer. When she spots them she picks up her cellphone and calls her boyfriend who races over with his budy and quickly dispatches two bucks heaves them in the back of the pick-up and away they go. Elapsed time for the hunt was less than 5 minutes. The lady did not stay for the hunt she merely spotted the deer for her complices. Even though she did not have a gun she was complice to the illegal hunt. So if a game warden spots you doing this he might presume that you are part of a poaching team, that you are the spotter. Be wise and don't do it.

this is what i was thinking . i say yes it would be poaching. hell if i was the warden and i came up to some one i would hold them there and search all over the ground and make sure they did not toss out the gun when they see the headlights comeing..

Includes lying in wait for, searching for, being on the trail of, pursuing,
chasing or shooting at wildlife, whether or not the wildlife is killed,
injured, captured or harassed. You need a hunting licence to do any of
these things, except where the Fish and Wildlife Conservation Act , 1997
states otherwise.

So it would depend on how anal the CO or PO was...looks like you can get charged for illegal hunting for: bird-watching, scouting for deer/moose/turkey etc.

Just make sure you don't have a firearm in the vehicle...and you should be alright. :)

I seriously doubt any court would uphold an illegal hunting charge if someone was simply out taking pictures of animals.
 
It's VERY MUCH illegal here in NB. Even sweeping an open area by slowly turning into a field with your car to "turn around" could land you in question.
