Technically an FRT is just a reference and not a law so you could sell a firearm without one. The problem happens if you are in a grey area and the police decide to lay charges relating to the classification of a weapon . Then you are responsible to prove that your gun fits in the correct category. Courts tend to side with the FRT though so....
Should note this wouldn't really fall into a grey area , we know it will be classified R and not Prohib.
