    This is correct, these radio's are not certified for use in frequencies other than those allocated to Amateur Radio. Also one needs to keep in mind, GMRS is limited to 2 watts, and FRS limited to 0.5 watts max.

    See below excerpt from Low-power Licence-exempt Radiocommunication Devices — Frequently Asked Questions;

    "By law, licence exemptions only apply to radio equipment that has been tested and certified to comply with specific technical standards, and operates in specially designated frequency bands. Such restrictions are necessary to ensure equitable access to limited radio frequency spectrum by all radio users, as well as to ensure the orderly development of radiocommunications in Canada."

    these radios are also illegal to use on amature bands, as they will broadcast outside the ham bands.

    What if you just use it to monitor the logging trucks so you don't get punted off a cliff. They don't stop.

    Receiving is ok. Transmitting requires a license.

    Baofengs are notorious for splatter, so if you use them near the end of a band, you might inadvertently transmit out of band. In this circumstance, they could operated contrary to the Radiocommunication Act and Regulations. Additionally, they often also have a TX range that is capable of transmitting out of band (which is only ever allowed in an emergency). However, as far as I'm aware, neither of these properties specifically renders the radios illegal.

    On the other, possession of a radio apparatus without the appropriate license or exemption does appear to be an summary offense (section 4(1) + section 10(1) + regs 15.3).

    Amateur radios that transmit outside of the ham bands are illegal. Lots of truckers buy ham radios and have the transmit range opened up because commercial VHF radios are usually more than twice the cost. The fact they are user programmable is the other attraction. If you don't have the software and programming cable, commercial radios usually have to be programmed at a radio shop for a fee per channel.
    Industry Canada sets up inspections at weigh scales in BC infrequently to check for this and confiscate such modified radios. I highly doubt you would ever run into them with a Baofeng radio in your personal vehicle/possession. Best advice is stick to GMRS or FRS frequencies if you want to chit chat Go online and have a look at the spectrum map for the VHF band and have a look at where the aviation, marine, resource road etc..frequencies are. Be courteous and move on if someone comes on the frequency and tells you you're interfering .
