Apples and oranges. Rimfire pistols have always been limited to 10 rounds. Their argument regarding the charger is valid under the current construct of the law just as the LAR 15 is designed around a Pistol.
That said the charger should have been designated as a restricted short barrel rifle since it was based off of a 10/22. Limits it to the range and doesn't make everyone who has a Butler Creek magazine as a criminal.
Now whether the law changes under our current govt it wouldn't surprise me
...

He could be right. Pistols in the US do not require an NFA tax stamp while short barreled rifles do. Make an AR pistol and throw a brace that could be used as a stock and you get around the $200 and the requirement to register it.
We see the same thing happening with the BCL 102 and the Mcabee.
The AR as a pistol probably would have shown up but ultimately would not be as popular if it wasn't for the NFA requirement

take any lower and built it into a pistol then take it to one of the fella's that inspects guns and have it measured, call CFO and have the registration changed to a pistol.
they may not even require you to take it to have it measured, depends on who you talk to and what kind of mood they are in.
