A charter challenge won’t work! There is sufficient case law to undermine a section 7 argument based on liberty. Further your argument on 117.15 is likely too weak to be heard. I'm certain that your legal team are already examining this, but Canada is a signatory (and co-writer) of the UN Declaration of Human Rights, Article 17 of which reads (in its entirety) :

(1) Everyone has the right to own property alone as well as in association with others.
(2) No one shall be arbitrarily deprived of his property.
