Looking quickly through the lawsuits... is it true that ATRS is only seeking damages and not challenging the OIC? Why are we donating, if so? The only win we would get is ATRS gets a payment and we don't see another ATRS rifle!?

That is a pretty big spin on the information.

We have seperated from the CCFR case which is challenging the OIC, that is true. We feel that we were strategically forced out by the government, when the Alberta CFO issued us a cease and desist letter in November of 2020. That cease and desist has damaged our business, cutting our overall sales by approximately 85%, so yes we are seeking damages. Also some of the damages we are seeking are for breach of charter rights, which would have resounding effects for ALL gun owners.

We chose at that time to file an action on our own specifically addressing our 3 models that are not listed in the OIC, and are instead "prohibited" only by the FRT. In doing so, the aim was to choose a smaller fight and progress faster. It's also important to note that while we can only fight for our 3 models, the MH, MV, and MS, the RCMP "banned by FRT" 8,000 models of firearms above and beyond what the government did in the OIC (1,500). And when we win, that will have an immense impact on those other 8,000 models that are illegally banned.

To challenge the OIC is an enormous fight, and the CCFR has got that handled and has our full support and gratitude. We're trying to focus specifically on the "behind the curtains" illegal actions that have taken place AFTER the OIC.

Pretty important precedent to be able to fall back on. When progress is made in this case and once fallout from virtually-assured appeal of the verdict, this can be excellent leverage to cooperate if CPC codification of legislation doesnt come to be

i wonder how pissed off the RCMP and The Turd will be when they see that 95% of those banned guns are NEVER turned in,LOL.they know about the AR's but not much else,they have zero clue where the rest of them are, and who owns them,i remeber the original Long Gun registry was brought out,they thought every body would just follow their order,little they know that their LGR would never get above 15% of the guns known to be in the country,they were fumming,how dare citizen not obey their orders,LOL.they kept extending the amnesty period for almost 3 years,they kept making the penalty harsher and harsher for those who din't register,they finally just gave up,and 85% of the guns in country at the time never got registered,in today's world we live in,and with The Turd letting all kinds of anybody in,it's a pretty garanteed fact that 95% or more will never turn anything in or register anything,which will piss them off royally,
 
Is the cease and desist a public document or is there anything counsel will allow out? Seems like a very heavy-handed action on the part of the CFO.

The letter from the cfo has been public for several months now. IIRC it was part of the massive set of documents served back in November? when the action was files.
Check some of the other ATRS threads to find it or email ATRS as I did inquiring for the reason some of my more recent MS orders were ready but no being shipped.

The OIC IS law and although it is being challenged by other actions, chances of successfully overturning the law is historically quite low. Not impossible but the case would be a massive undertaking, hence the CCFR attempting to convince a judge that her employer made an evil law with no basis. Given the governments hiding behind cabinet privilege they have no evidence to produce, this actually could help in getting the OIC thrown out.

ATRS is a small and relatively unheard of shop, so has a very small following of support in comparison to say the CCFR. For them to "tilt at windmills" trying to overturn the OIC would be financial suicide. Especially given the dirty pool the Alberta cfo played by her self determination that despite everyone else claiming the contrary, she felt that the FRT WAS law and enforceable. This act of malfeasance/misfeasance literally killed a major percentage of ATRS's income. Pretty hard to fight a legal action with no income, especially the way the government fights actions they are involved in.

Also of note was the flat refusal of ATRS to hand over to her, all their clients information. Not everyone is willing to risk jail to stand up for what is right when the governments minions are WRONG!! Talk about an abuse of power and breaking untold numbers of privacy act laws.:runaway:

The other cases have provided a significant amount of ammunition for the ATRS case. The admission by Smith in court that the FRT was merely his opinion and was not legally binding was a great benefit as I see it. This pretty much torpedoes the cfo's letter to cease and desist. They just need the Judge to agree and put it on paper.

Meanwhile a small family company has gone 10 months now with minimal income due to this malicious threat by the cfo, 10 months in which they could have been making and selling their rifles, and with little competition. That in itself should demand compensation from the government, cfo and the rcmp lackeys who unlawfully altered the FRT's of not only ATRS products but over 8000 others that were not listed in the OIC(the law).


Should Rick and ATRS win in court a great many people will once again be allowed to use their lawfully purchased firearms. Rick has been very clear that should the win a settlement but lose on the classification issue, the several thousand folks who have Modern Sporters held up in legal limbo would be repaid, something that currently is impossible for them. They took the orders, they made the product and in doing so had to spend the money to purchase the raw materials, pay their machinists, etc. etc.

For these reasons we should be supporting this cause as if it dies from lack of funding we ALL lose.
Any compensation that ATRS may receive from the government will never come close to fixing the anguish being suffered by Rick and his staff.
For 1 to put their entire life into creating something only to have it destroyed by a rogue regime is morally wrong and needs to be stood up for.
