Hi There,

I was given the subject revolver by my grandfather and registered it during an amnesty back in the early 90's. The barrel length is about 65 mm.

I, unfortunately, let the registration lapse. I recently attempted to update the registration and was refused as the said revolver is now prohibited due to barrel length.

I was refused grandfathering because I let the registration lapse, therefore it was not continuously registered.

Anyway, I was given the option to petition the courts, but I don't have time. I'm posted to Alberta from Manitoba next week.

A local gunsmith said he'd come get it and just add it to his collection, but he has failed to appear. I can't transport it, don't want to call the local constabulary to have it picked up and destroyed..I'd like to rehome it.

Anyone interested in it and know a way I can transport it to you?

Another option just presented itself:

You got this gun from a relative, and it has been continuously registered. Your PAL and 12(6) lapsed, but this firearm is a 12(7) eligible one. The 1906 (just re-read your original post) was discontinued in 1941. 12(7) means that you get to keep a firearm provided to you by a blood relative and more importantly, made before 1946.

The gun wasn't unregistered, since the only loss would be you didn't renew your PAL.

You should be given your 12(6) for only this handgun (if you have other 12(6) / post 1946 guns they're gone) but they definitely need to take into account its age and the fact that it's a family heirloom. Telling you to go to the courts is ridiculous. Say the magic words: 12(7), and demand to know who you need to talk to. Nobody needs to take it away.

Do you have any close relatives with their 12(6)? You can transfer the gun to them lawfully, and they can transfer it back if there's some idiotic issue. But this one is definitely pre-46. H&R stopped making them in 1941.

It could still be equipped with a 4.25" barrel if you want to let it get messed with, but there's really no need. This is exactly the reason section 12(7) exists.
 
And sorry, I over complicated this.

If CFC refuses to let our friend keep his Grandpa's pre-46 prohib under 12(7), he simply needs a close blood relative with an RPAL to give it to. Brother, Sister, Father, Son, Daughter, Wife... Once he gets his RPAL back, they can give the revolver back to him and done. As per 12(7).
