i put a folding stock on my marlin 795 and am wondering what the legal overall length needs to be when folded? done some searching but can’t find anything definative. was thinking about chopping the barrel some but with the folding stock i want to make sure i’m not creating a prohib!

I did not look it up, but I think that 26" minimum is predicated on the arm being able to fire in that configuration - I am quite sure several guns here will come apart into much shorter than 26 inches long, but can't be fired that way. But, I did not look up the regulation to know for sure what words it uses ...

See section 84 of the Criminal Code:

prohibited firearm means

(a) a handgun that

(i) has a barrel equal to or less than 105 mm in length, or

(ii) is designed or adapted to discharge a 25 or 32 calibre cartridge,

but does not include any such handgun that is prescribed, where the handgun is for use in international sporting competitions governed by the rules of the International Shooting Union,

(b) a firearm that is adapted from a rifle or shotgun, whether by sawing, cutting or any other alteration, and that, as so adapted,

(i) is less than 660 mm in length, or

(ii) is 660 mm or greater in length and has a barrel less than 457 mm in length,

(c) an automatic firearm, whether or not it has been altered to discharge only one projectile with one pressure of the trigger, or

(d) any firearm that is prescribed to be a prohibited firearm; (arme à feu prohibée)

The key number, in your case, is 660mm. Meaning an OAL of 660mm or greater will be okay, but an OAL less than 660mm (or shorter) might prove to be problematic.

Don't forget that the barrel length is also part of that definition. Meaning that one cannot cut one's Marlin 795 barrel down (at all) if the end result would be shorter than 457mm.

I don't know how long your barrel might be, but - legally - it cannot be shortened to less than 457mm.
