8 round mag issues

Should be compatible, yes, but mags are notoriously fickle for all semi autos. Some brands and models just won't work well in your gun. However, I'd take care to be sure the issue is with the mags and not the pistol itself before running out and buying new mags. Try before you buy, if possible. If not, be prepared to lose money on those that don't work well.

From your description, it sounds like the feed lips are causing the slide to stay open, correct? Are they catching the slide itself, or the slide stop?
 
Put lots of oil on the slide rails and just shoot it. New guns can be very tight and need to be shot in a little. If you are still having these issues after a few hundred rounds I would worry but until then I would think it is just "new-gun-itus" :)

Its a NHC and the mags are NHC. the mag release seems to be fine. However thats just by looking down the magwell.

P.S everything is brand new.

It's a Nighthawk?! Ummm, take it to the store where you paid through the nose for it and make them figure it out. NO excuse for them selling you mags that don't work 100% in the pistol, regardless of how new it is. And don't skimp on mags - If the priciest Wilson ones are the only ones that work 100%, then use those ones.
