Herrington and richardson top break revolver. his was pre 1900s.

When I was a kid, my granndfather was neighbours with a guy who had one of these... (22 years ago...). His was pre 1900s.

Needless to say, I want one...

I have not seen any info, are they prohib or just restricted, or do they qualify as an antique?

With that barrel length it would be restricted. If I'm not mistaken there's a laundry list of modern calibers that exclude a gun from the antique list and I believe .22 LR is one of them, so even if it were pre-1898 it wouldn't qualify. Someone feel free to correct me.

Here's a pic of my H&R breaktop. It's a 32 S&W and 3" barrel so it's prohibited for 2 reasons. It shots modern ammo.

sooo..... would one like in the pic in .38 S&W be restricted? and if it was 38 S&W black powder could that make one an antique?

If it is not an antique and the barrel is 105 mm or less it is prohibited.

So one with a 38 and longer then 4.2 inch barrel would for sure be restricted.

Correct, just be sure that it is marked with the cartridge size on the left side of the barrel. With these old H&R breaktops, if it's not there, they are only rated for blackpowder.

Anything chambered in .38S&W cannot be classified as antique.

Lots of things that fit *most* of the criteria for antique status are axed by some other technicality. I have a single shot pistol pre 1900's that's chambered in 6mm flobert. Unfortunatly that is considered modern ammunition and is not elegible for antique status.

Whether ammunition is considered modern or not is irrelevant for classifiaction purposes.
If you refer to the Antique Firearms Regulations, Section 1, para. 6, you will note that a rimfire pistol which was made prior to 1898, and which does not chamber .22 Short, .22 Long, or .22 Long Rifle ammunition has antique status.
If your pistol is chambered to accept only 6mm Flobert - and will not accept any of these three longer cartridges, it should be antique, assuming you can establish pre-1898 manufacture.
