I have a B&T TP9 and was wondering what it's classification is? On the reg it says "commercial version". Commercial version of what? Of the B&T MP9? If so, the MP9 is select fire machine pistol.......so that should make the TP9 version a semi auto pistol correct? Why then must the mags be pinned at 5 rnds and considered an SBR (short barreled rifle)? If it is in fact a semi auto pistol...then the mags should hold 10 rnds legally,no?

I have an extra top cover (polymer) that has a small picatinny rail on the side that a friend sent me from the US. This B&T product is stamped "MP9". Even though there is no serial number on this, what are the legal implications in using it in place of the top cover that is stamped "TP9"? Are there implications other than it looking very cool?
 
The TP9/MP9 ships with a folding stock, even though it is a sub machine gun that can fire with one hand, the stock is what gives it the legal status of "rifle". This is what I believe to be the determining factor of whether it is a rifle or pistol.

the glock series pistols also can have a stock, but because it was never designed to have one and it was an aftermarket accessorie, it is considered a handgun.

Same with the mags, legally if the magazine was designed for a semi auto/full auto rifle, then the mags will be pinned at 5 rounds. EVEN if the magazine is going to be used in a handgun, so the law says "whatever the magazine was designed for and not what it's used in determines capacity".
