yes thats what I'm thinking, but there is no marks on the bayo so it might be something else.

It won't fit on a Martini Henry and I don't have a Snider to test it on.

It does appear to be a British Pattern 1856/58 sword bayonet. There are four variations that I can make out and they all involve variations of the hilt (the mortise slot for the lug on the rifle and the top of the spine) . If you could post a better picture of the top edge of the hilt maybe we could come up with a better idea of which one it is.

Portugal has a similar one for the Westley Richards rifle, but the grip plates appear to have only two retaining rivets and the blood groove is different.

Looks like a Pattern 1860 sword bayonet for the short ML Enfield and short Snider BL.
These were commercially made without military marks for volunteer units and foreign contracts ,ie War of Northren Aggression 1861-65.
They usually have a makers name or trade mark on the ricasso.
What is the muzzle ring inside diameter?

I'm not seeing any markings on the ricasso thats my biggest problem

apparently after the Civil War many combatants made their way to Canada rather than join the Union believe it or not bringing a few trinkets with them.

Pattern 1860 sword bayonet also works. It corresponds to the Enfield Pattern 1856/58 sword bayonet with a bushed muzzle ring and a filed down mortise to fit the Martini Henry.
