Its happened a few times now, when the gun is empty the slide doesnt lock back. What could cause this? (this gun has less than 150 rounds through it, basically new)

The first suspect is your own thumb.

Be aware of where your thumbs are during firing. Don't contact the slide stop.

The second suspect is the magazine.

Try another magazine (if you have one).
Clean the magazine.
Replace the magazine spring (if you have one).

Took the mags apart and cleaned them, hope that helps, don;t think my thumb is in the way as its in the same position it was the first 100 rounds without this issue.

Try racking it back on empty mags a bunch of times. If it locks, its likely your thumb. Shoot it left hand only (just load a few rounds). If it doesn't lock back, check the followers for any broken bits where the slide stop engages them.

Do you have original magazine?

other magazine with big rubber "but pad" (floor plate) might also create the problem. Since the mag is not inserted properly and completely by just few mm because of the thickness of the pad, the slide can't lock open.

I had the same problem and it was the mag. I changed the follower and spring and it worked for me. Maybe try a different mag as suggested above.

Are you shooting full powered ammo? Is the recoil spring too heavy for your loads? Is the magazine follower high enough? Does the problem reoccur when other magazines are used? If someone else shoots the gun does the problem reoccur?

Shooting 147gr, magazines are original Beretta. Gonna try shooting one handed next week and see if my thumb is in the way lol. Thanks guys

I shoot a Brig96 and this issue is nothing new to me.

I'm surprised nobody mentioned a worn slide stop spring. :) Especially Slavex.

A worn recoil spring will cause this as well. It may have enough power to cycle another round, but not enough to lock the slide open.

I replace the recoil spring and firing pin spring and the slide stop spring and I'm good to go again. I replace all the springs around the 5K mark as a maintenance procedure, but the recoil and slide stop springs need attention way before then.

Ruling out your thumb, additional possible causes may be weak magazine springs and puff handloads. Excessively hot loads will manifest similar issues. Also mag springs installed backwards and simply a drop of CLP in the right places.

NB. With semi autos, always replace the firing pin spring when you replace the recoil spring to keep proper timing. Especially if you see skidmarks on your primers. I use Wolff variable power recoil springs in all my guns.

His gun is brand new. Sounds like its either got a manufacturing issue, or a personally manifested problem. :)

FWIW, when I switched grip technique, I did catch the slide release a couple times, but that was it.

Weak springs don't stop the slide stop from locking the slide back. The weak slide stop spring will cause it to stay locked after you rack it as it won't auto disengage. Weak recoil springs just beat up your gun. Weak mag springs can cause it, or debris above the follower stopping it from making it fully to the top of the mag. One used mags flaking of the surface where the stop hits the ledge on the follower is common. New followers are cheap. Factory rubber base pads don't cause issues as the rubber is attached to the bottom of the metal pad, not increasing the thickness of the bit that slides over the lip on the bottom of the mag. Debris in the mag well can cause this too, but that usually results in mags not seating right.
