buying a prohib for the purpose of having it stripped

Here is another twist on breaking a M-14 for its parts.
Apparently, if a 12(3) CA is dismantled completely, the stripped receiver no longer has 12(3) CA status. It becomes 12(2) - full auto - but is not and cannot be registered as such. This situation was first reported when someone attempted to transfer a stripped M-14 receiver from a dismantled 12(3) rifle.
This is similar to the situation respecting 12(6) pistols. Rebarrel one and it can be reregistered as restricted. Remove the restricted length barrel, and the receiver reverts to 12(6), but cannot be reregistered as such.

This makes little sense given that the receiver on it's own is only a wepon if thrown at someone or used as a short club. In the case of the M14 a few additional and unaltered parts are required to make a 12-3 select fire again.

It isn't a question of it being a weapon. A stripped receiver is legally a firearm. The interpretation is that the firearm was a CA when configured and registered as such. Strip it back to the bare receiver, and the original classification applies. Doen't matter whether it makes sense or not. If that is the interpretation, a person either has to live with it, or challenge the reclassification in court.
 
Tiriaq is right on the money guys. Here is what's been done to avoid this conundrum in the past by a few quick thinkin 12-3 m14 owners who had me come over and swap their USGI parts into nonrestricted receivers. To maintain the 12-3 status and there is nothing to report? Put the take off 22" chinese barrel on the GI receiver. Might be distastefull but as long as there is a 22 inch barrel, it's status does not change.

Yes, that is the way to maintain the 12(3) status, for the rifle, and perhaps for the owner as well.
 
Well if I was in the OP shoes I would buy the Norc M14 the you buy the 12.3 M14 & have some one like M14 Doctor play middle man and strip them both. Install all the US parts on the Norc receiver & all the Norc parts on the US receiver & deactivate the 12.3 US M14 . Now you have your non restricted Norc M14 with all US parts & you have a real US M14 (with Chinese parts)
to hang on your wall or sell as a dewat :D
