Can I buy restricted from Marstar before joining a club?

So do you live in Ontario?? Do you have a club membership?

Ya I know, easy for him to talk big when he lives in a province that allows a transfer without club membership. Give a CFO in a different province a call and see how your attitude goes over. I know some people in ontario think that's all there is to Canada but there really are other provinces too. If one of us calls up our CFO and tries raising #### about club membership, all we're likely to accomplish is to get red flagged for searches and delay transfers. Like I said, unless you want to foot the legal bill to take it to provincial supreme court like they had to in NB, you have made as much of a point as you are going to. Doesn't matter if it's law or if it's right or wrong, it's the way it is and like has been shown in NB, people saying it's wrong doesn't make a difference. They required to be forced by the courts.

Sigh... you miss the POINT

MEMBERSHIP is NOT required in C-68.. and that is FEDERAL.. that applies to us all.. ALL of the CFO's as well... regardless of what province.

So instead of whining.. stand up and fight back.. en masse!


And it DOES matter since it is not LAW... grow a set and help haul the CFO's on the carpet for their BS "policy" which is not law.


If you and everyone else does not fight back and continues with such drivel.. you deserve to LOOSE YOUR GUNS which is what will end up happening.

In fact I have consistently done the opposite.. sure there are some like that.. but they are NOT the majority by any means and the BS prejudice of that sort is yet another problem in Canada.. be it that statement about Ontario etc.. or those #####ing about Quebec.. etc etc.. we are all CANADIAN.

Oh shalimar, you still don't get it do you. In a perfect world where things actually work the way you present them to, I would agree with you on all your points. But in the real world it don't matter whether it's law, policy, right or wrong. It's happening and the only thing that will stop the CFO from doing it is being forced by the courts. Take off those rose colored glasses, people are not going to rise up en masse over this issue. We have to first get rid of the LGR before we can motivate enough gun owners to help out us restricted firearms owners. Us restricted firearm owners had to jump through enough hoops to get the RPAL, most of us have more important issues in our lives and decide to jump through that one extra hoop to keep the CFO off our backs. It's going to take someone to put their ass and tens of thousands of dollars on the line to take this to court. And success or fail, deal with the political ramifications. So if you want to wire 10 G's my way I'll call a lawyer and get the ball rolling. If not, maybe you should be the one who stfu. You talk so big about this here on the forum, what are you doing to fight it? I'll give you a hint, complaining on a web board does not count as fighting nor does sitting their being pleased with yourself for not having to get a club membership. I'm not going to keep arguing the same point back and forth in this thread with you shalimar so if you want to respond to this I won't be back in this thread to read it.

Legislation rarely spells out all the operational procedures under a law. It in the case of this section of the CFA , 27 , it enables the CFO to excercise discretion...effectively to make "law".
When Sec 27 authorizes the CFO to..
(c) decide whether to approve the transfer and inform the Registrar of that decision; and

it permits the CFO to turn down a transfer on any reasonable basis. If the lack of membership in a range made the CFO believe that transfer was not for a legitimate purpose , then the individuals only recourse would be to appeal it to a judge....and the judge would then weigh the two sides of the argument....after considerable time and expense...
To say that because it does not specifically state in the legislation that one needs a range affiliation , it must mean one doesn't need it is incorrect.

Sorry but again that is not true... the CFO's cannot make law. The law as it stands now does not state at all that a range membership is mandatory.. Therefore by law it is not regardless of what BS the CFO's spew

I for one am calling them on it... and everyone else should be doing the same.
