Counterfeit Leupold and options

Purchased a Leupold VX3i 3.5-10x 40mm from EE last year, all looked great in original Leupold box, from a respected member, etc... so I put it one side and when moose season came up this year, put it on my rifle. Noticed it was fogging up, somewhat blurry, so I removed it and sent it to Korth for repairs. No big deal I thought. It came back with note saying it was a non-leupold product. I called Leupold in the US, they confirmed the serial number was on the list of counterfeits, and after asking me a few questions, determined it was counterfeit. The tell tale sign was the power indicator ring was on backwards.

Messaged the seller and asked that he take it back and refund me after receiving it. He could then take it back to the dealer who sold it to him, since he earlier indicated he had paid sales tax on it. His response was ... "no way that's happening, it's a Leupold"

I have done almost 600 deals on EE, and 99% have gone excellent. In the 1% where there were issues, I tried my best to honestly deal with it by offering a full refund, exchange, partial refund, etc. No way would I accept $500 for a counterfeit scope, even if I didn't know it was so when I sold it. Many of you I've dealt with can attest to this.

Am I wrong in expecting a refund? Am I stuck with a $500 piece of junk?
 
Can the respected member at least provide you with a copy of the original receipt/invoice so you can contact the dealer and see what they say?

Unfortunately, if the CGN member is unwilling to help you out, you are likely out of luck. I agree with how you'd propose to deal with the situation were you the seller, but unfortunately you can't hold everyone else to that same standard.

I would contact the respondent and affirm that it's most definitely not a Leupold and ask them again to assist with resolution. I wouldn't be surprised, though, to find that the member purchased the scope from Amazon or Ebay and not a dealer licensed by Leupold, in which case you're pretty much hooped. I'd add the member to my "Do Not Deal Again" list and chalk it up as an expensive lesson.

Sorry to hear about your troubles --- it's definitely a buyer beware environment with all the counterfeits floating around. I purchased a used red dot from a legitimate dealer, which turned out to be a counterfeit. The dealer was willing to take the product back as they had been duped themselves.

I would be having a discussion with said member. After that I would be leaving another FB.

I have seen a guy selling counterfeit leupolds at the Orangeville gun show. He is there every show. I don't know why Leupold/Korth put up with it.
I have mentioned this to them in emails.

One thing I refuse to do is buy Leupold scopes from anyone other that a retailer whom I trust.

There are too many of these around and they look very good, but I won't take the chance because of exactly the situation you are in.
The guy you bought it from will just deny that is the scope you got from him.....he will say the one he sold you was genuine.
Then its a "he says she says" issue.

No win situation for sure.
 
The seller should definitely do the right thing take it back and refund your money.

Earlier this year I was in the process of purchasing a used Leupold scope on the EE and it came to light that the scope in question was indeed counterfeit. At that point I had already paid the seller but he had yet to ship. He didn't ship the scope and without hesitation refunded all my money as I requested. Last I heard he was taking up the counterfeit issue with the individual/store(?) he had bought it from.

The response you received from your seller: "no way that's happening, it's a Leupold" is ridiculous as clearly the scope is NOT a Leupold.
 
It is a ##### though. Does any of the correspondence between you and the seller have the serial number in it? If it does then a pic of that correspondence and the scope showing the serial number sent to him might convince him to make some kind of deal. Without a positive ID of the scope he may not be sure that you are not trying to scam him.
 
Sad news - If I were the seller I would have refunded the money <no questions asked> now that being said - there was a fellow at a local gun show selling a Leupold Vx3i 3.5-10x40 for $250.00 with a sign on his table saying "all sales final" now I think he knows that it's counterfit

I agree, call him out, and he should be kicked off the forum. Knowingly selling a counterfeit item misrepresented as real is still against the law as far as I know.

Seller had multiple options and they picked the worst one

Leave a neg rating and forget about it
