I picked up this 40 cal eagle and my mags dont feed well
they come to a point and get stuck and i have to force them in, then if the mag is empty i have to force it out, it only drops out if the mag is full of ammo.

also my rear sight always shifts. i hammer it into place then transport in my case and then the sight shifts over as if it wasnt sitting properly.

i appreciate any help you gents can give me in this matter.

Did you buy the BE new? Are the mags 'genuine' BE mags? If so, take it back to the selling dealer.
When you say the "mags dont feed well", do you mean you can't insert all 10 rounds into the mag? Baby Eagle mags are very difficult to get the 10th round into...they do ease up after a while, though. Use a mag loader, it'll save your thumbs.
You really shouldn't be "hammering" your rear sight...I'd suggest letting a good gunsmith have a look at it...he will fix that.

the be was bought used off another cgn member. i believe the mags are genuine. im not having trouble loading the ammo. its when i try and insert the mag in the gun. it slides in 3/4 of the way smoothly and then hits a point where i have to force them in. when you presss the mag release, the mag wont fall out of the gun, you have to give a nice pull to get them out.

I have seen this problem with factory mags. The rear of the cartridge batters the back of the mag and bulges it out slightly, causing it to become more difficult to insert and extract the mag. With a set of pliers, you can bend the top rear portion of the mag back in until it fits again, but you should have a new mag to compare it with.

There are a LOT of 'counterfeit' BE mags out there being sold in Magnum Research packaging. ALWAYS check the mags to ensure that they have the MR "rounded triangle" logo stamped on the side.
As a point of interest, the factory "blued" mags for my Beretta swell slightly when loaded with ten rounds...this makes them a bit 'sticky' to insert in my Vertec. I just got some new NP3 factory mags, and they don't swell.
