First I want to declare I only use soft point or ballistic tip ammo when I hunt.

Someone once told me you cannot hunt with FMJ ammo in NB as it is illegal (and of course somewhat unethical).

I have gone over the hunting regulations and the actual hunting legislation and I cannot find anything to back this statement up.

So If I hunt with 223 ballistic tip ammo in the rifle for coyote but decide to use cheap 223 FMJ for plinking at a pit for 1/3 the price, am I in the clear if caught in the woods with 223 FMJ on me?

I had a quick look through the NB Fish and Wildlife Act, and its regs, and I didn't see any reference to full metal jacket ammunition either.

I remember hearing/reading it at some point about not using FMJ for hunting, but I don't think is expressly said "full metal jacket". If I recall correctly it was worded something like "non expanding ammunition".

That being said any time I've run into DNR or whatever they're called now they've only ever checked licences, and if it was bird season they may ask if you're carrying any slugs or check caliber outside of deer/moose/bear season. I've never been asked to look at what kind of bullet was in the ammo I was carrying.

I know this doesn't answer the legality of anything

You can have FMJ in your possession while hunting coyote, although some may say they are unethical to use, I have no doubt that a well placed shot would result in a kill, and may cause less damage to the pelt.
I like to use the ballistic tip ammo also.

I am not finding those words or terminology in the Act or regulations.

Nearly 30 years ago I used FMJ on groundhogs, blew them up like they ate a blasting cap! Would likely work OK on a coyote with a well placed shot, marginal shot maybe not so much.
