Fowling shotgun capacity legality???

This has probably been asked a 1000 times, so sorry for bringing it up again, but I couldn't find anything, thought this would actually be stickied TBH. I have a benelli nova that has a three round(2+1) 3.5" mag capacity. As I understand it 3 rounds is max for a hunting gun. This gun however takes 3 2-3/4 shells in the tube. What if I choose to hunt with 2-3/4", do I have to plug this thing?

There is something wrong with your plug, three 23/4" shells have a length a bit over 7" and two 3.5" shells are just under 6". did you possibly lose the plug when cleaning?
 
nope, but I did buy it used. 3.5" inch shells in my other magnum barely fit 2, this one there is some extra play, and 3 2-3/4" shells just barely fit. I bet the plug was altered and I'll have to track down a new one. I'll take a look and see what I find. Thanks!
 
a lot of old 870s have nothing more than a bit of broomstick, cut to the appropriate length and turned down in a lathe- mof, i thnk my first 870 had that from factory
 
Just pickup some wooden dowel, cut to length so two 3.5" shells barely fit and sand the edges smooth. Thats what older shotguns used.
 
Buy a plastic one and trim to fit as wood holds water and moisture in the mag tube.

Hasn't been an issue with the 3 of my shotguns that use a wooden plug. As long as you keep your mag tube clean and lightly lubricated and don't put your gun away wet it should be just fine.

Some where in the Migratory Bird Act it states "Mo more than three shells in the gun while hunting Migratory Game Birds"
So that would mean two in the magazine and one in the chamber.
You should not be able to put three rounds no matter what shell you choose(2-3/4'' to 3-1/2'') into the magazine.
From what I have read and understood it would appear your guns plug has been altered and it is a good idea to have the correct plug installed before you head afield.

Actually all would be illegal with this line of thinking if you were using mini-shellls of only 1.5".....I would think it would be 3 shells of what is in your possession while hunting would meet the legal requirement.??

Here (Sask) the CO's check with a gauge , if the plug gauge goes in too far you are in violation whether or not the ammunition you are using will only hold 2.
