The Alberta hunting regs state that you cannot hunt with a magazine larger than 5 shots, where does this put the M1 Garand for hunting? Is it legal to hunt with using 8 shot enblocks?

Better question: what hunting senario requires 8 shots?

None that I am aware of, but you put in an 8 shot enblock with only 5 rounds in it... go ahead, try it.

Yes, I realize that. I happen to have about 15 - 8 round enblocks and no five round ones. If it is legal to use the 8 round ones, it saves me the hassle of ordering 5 round ones.

Check with the Dept. for an exact interpretation. Maybe an 8 shot rifle loaded with only 5 rounds might be acceptable. If you want to load five, and have only 8 round clips, you have 2 options. Load 8 and manually cycle the action three times, or, insert an empty clip, then load five rounds is if they were going into a fixed top loading magazine. Can be done. But I suspect that a 5 shot clip would have to be used, unless the Dept. operates with people loading 5 rds on the honour system.

I asked an Alberta Fish Cop at the range few years ago. I used to put three empties and five live in the en bloc.

He said that he would charge me for "having a semi capable of putting" more than 5 rounds in.

Get a 5 rounder or two just to CYA.

In ontario also, according to my local MNR office (Guelph) somebody there said about my Lee Enfield (10 shot mag) that if it was historically exempt from the Firearms Act, it would be exempt from hunting regs in the same fashion.
Phrase it that way when you call a local fish and game officer: "My Garand is exempt from the Firearms Act mag limits due to its historical signifigance. Does the rule apply equally to provincial hunting regs as it does to the Fed firearms act?"

IMHO

No....Ontario Hunting regs are seperate matter entirely. Five rounds only in a semi, regadless of firearm type.

The rule only applies to semis, so your lee enfield would be exempt for the fact that it is a bolt action.

Powder Burner the Garand is a Semi auto, while the SMLE is a bolt gun, it's like comparing apples to oranges. In Alberta the magazine capacity only applies in this scenario to Semi's.
As written in the Alberta regulations:
It is illegal to use the following for big game hunting:
an auto-loading firearm that has the capacity to hold more than 5 cartridges in the magazine.
The capacity to hold is the catch term there, you must use a 5 round pingy to be legal in this situation.
Quite worrying about 3 non active rounds in the en bloc and give Marstar a call the 5 round pingys are only $5.00 so buy 3 get them shipped for you for not much more than than $20.00, spend the cash and quite being a cheap SOB.

I'm assuming a 10 round british .303 is not legal then..?

There are 5 round magazines for Lee Enfields.

EDIT: spelling corrections

Loading eight in your Garand is perfectly legal for hunting in Ontario. You might want to carry a copy of the reg's in case you run into any armcahair CFO's while in the field... .

According to this document, Ontario regs don't limit the size of the Garand en bloc clip.

http://publicdocs.mnr.gov.on.ca/View.asp?Document_ID=10734&Attachment_ID=20631

Other provinces may have different hunting regs and may require en bloc clips of different capacities.

According to the following document, Garands are not limited in Canada to less than the 8 round capacity of the en bloc clip.

http://laws.justice.gc.ca/en/C-46/SOR-98-462/82866.html#rid-83011

Sadly enough, Alberta still limits semi-auto hunting to 5 rounds.

Good Luck
