Green laser/flashlight, problems with battery?

I got a cheap green laser/flashlight combo off eBay to use as a visual aid for dry fire practice. I don't ever intend to use it for live fire as it would not survive the recoil. It was advertised as running off two CR123A lithium batteries which are 3V. The flashlight works great, actually one of the brighter flashlights I have seen in this size. However, the green laser is giving me grief. Using new batteries it is REALLY bright, but only for about 30 seconds after which it rapidly dims and then shuts off. I contacted the seller and they are advising me to use rechargeable 3.7V batteries instead. Does that seem right? I am concerned with the extra voltage as I believe that could fry the LED flashlight. I will try to get a refund from the seller but if they refuse I will just chalk it up as a relatively cheap lesson.
 
I've seen those green lazers before, they suck down batteries like mad.
They would diminish with 2 AAA batteries in 30 seconds.
IIRC, they are only borderline legal. D*cks shining them at airplanes and hitting a pilot in the eye is the stated concern.
