Gunsmith DESTROYED 1911 Slide - Legal Opinions

Howdy Folks,


Not going to state who (yet) but one of the industry members on this forum who advertises gunsmithing services has DESTROYED my 1911 slide.


I shipped them my slide almost 3 years ago, and followed up with the rest of the handgun as they had stated they were going to fix the whole thing and put it back to the state it should have been in, should they have taken proper duty of care.


The date they received the slide was early February of 2023, they kept telling me there were 'delays' until I finally forced it out of them 11 months later that they had destroyed the slide completely and were uncertain of what to do.


A further 2 months after that was the timeline for them to suggest taking the entire handgun in for remanufacturing (as the 1911 slide would need fitment to be replaced). I then sent them my 1911 handgun in its entirety. I have not seen my handgun or any component of it since then.


They have had their lawyer on-and-off contact me about resolution and I've been forced to get 'nasty' with them to the point that getting a timeline out of them was difficult. The timeline they had provided this summer for resolution on this nearly 3-year struggle was September (now). Unfortunately they have blown past this date and I am now sat here looking at filing a lawsuit, as it doesn't seem I have any other option.


Given these circumstances, what would you do with a major gunsmith/retailer;


  1. Destroyed pistol slide and took a year to acknowledge it, now nearly 3 years in total since project start
  2. Offered nothing in compensation for nearly 3 years of lost enjoyment
  3. Still has not returned my handgun or any component of it since February 2023
  4. Expects me to sign a document waiving my right to sue them, with a compensation of only $2900

P.S. I'll add that they've been rude during this process and treating my frustration like I'm being 'weird', when I only got difficult with them after 2+ years.
 
they are giving him $2900.00 don't think he will get more thru small claims court
I definitely disagree. I think more like 5 figures, based on the amount of time I've been without my sporting arm.

Unfortunately they have so far refused to return my property, I am not able to provide anything but email receipts, as of this moment.


Do small claims court action.
This is what I am thinking, quick self representation. Then I'm not asking for legal costs, I'm just trying to be reasonable.

You need to be made whole.

You never stated what the slide was being sent to him for, I'm assuming to have an optic mount cut into the slide, but if it was for a repair, you have to understand that your starting point began with a f ucked pistol. Any compensation will begin from the condition of your situation from the onset.
 
What kind of 1911 is it? They range in price from a Norinco to a very high end pistol. Personally I would be happy with getting the lower back and money to get a new slide.

Would you expect costs for the new gunsmithing work and the damages for the loss of enjoyment ?

I wasn't going to, but based on their behaviour I feel its right that they should have to pay a Detinue cost for the unreasonable and intentional holding of my property.

I bought a 1911 to have an iconic handgun, and my enjoyment of that has been removed by their lack of care, for 3 years. To rent a 1911 at a range is anywhere between 13 an hour and 40 a day, depending on the facility.

You never stated what the slide was being sent to him for, I'm assuming to have an optic mount cut into the slide, but if it was for a repair, you have to understand that your starting point began with a f ucked pistol. Any compensation will begin from the condition of your situation from the onset.

The slide was only sent for a dovetail, they mangled the slide in the process to the point that its not possible to be repaired. Handgun was 100% functioning and in brand new condition.
 
I’d take the cash, get the working parts back and put a new slide on.

Who knows what you’ll get if you push it and who wants that headache at this point.

I’d ask for them to source a new slide too.

Thats actually exactly what has been happening.

After they notified me of the damages ( I had to force that out of them ) they insisted they would fix the handgun and get a new slide in.

I asked recently for evidence that this parts order was even happening and they refused to show me the order forms.

So basically they keep telling me they're going to fix it, and also refusing to return the handgun.

Worst part ? I believe them despite all that, they're arguable the biggest industry member on this forum .. if that gives anyone a hint.

You are not the only one to be screwed over whether it's by a gunsmith for work done or a warranty repair by a store. I'm included on this list. I get you are angry at how you are treated. I've been there along with others on CGN. You asked what other would do and I answered but wanted some clarity on some information that was left out.

Based on my experiences I would get my lower back and use the money to replace my slide and move on so I can enjoy my pistol. I would find someone else to work on my pistol. I wouldn't want to drag it out any longer.

Absolutely fair, I'm typing like a machine right now so please disregard any short language.

Just humour me, who would you send a 1911 to if it had been screwed up, off the top of your head ?

Was it the company that decided to ask for PAL verification on non regulated parts??
