(Help)Temporary export to USA

Hello Fello gun nutters i am sending a action to Montana. has anyone got any custom work done in the US what is the paperwork like. i had seen the forms online sometime but cant find them now, can anybody tell me what they did or where to find info on what i need to do.

Export is export.. temporary doesn't fit in.

I believe it requires export/import paperwork by you and the person importing it into the US... and more paperwork to import/export it back to you... it is not simple to do and will take quite some time to get it all in place before sending it...
 
Export is no problem, it's the import into the US which is the problem. The guy to whom you are sending the thing should be able to help you there. Regards, Bill.
 
can i not take it to him as if i was going to his home to shoot at his range then leave it there and pic it up in a month. i know guys go down to hunt turkey and dont do much paper work.

The permits to go hunting are very different than the permit to leave it there... it is the US import/export laws you are required to obey.. you should be checking with US authorities... the State Department I think.

They take these new laws very seriously and you do not want to try and get around them.

The question is, does it fall under the Form 6NIA?

I have had a 6NIA for years. You can certainly bring an approved firearm to the states for gunsmithing. However, the gun MUST accompany you when you return to Canada. You can not leave a gun in the U.S. and return to pick it up later.

There is paperwork that exists for this sort of thing, I would query the BATF to start.

Read the conditions on your approved ATF Form 6NIA.

You will find that the conditions specifically prohibit your leaving a gun behind.

ATF F 5330.3D (Form 6 NIA) — Application and Permit for Temporary Importation of Firearms and Ammunition by Nonimmigrant Aliens

The following restrictions apply to your approved import permit:

The firearms and/or ammunition authorized for importation by this permit are not authorized for permanent importation. The firearms and/or ammunition may not be transferred to another person within the United States. The holder of this permit MUST take the firearms and any unused ammunition back out of the territorial limits of the United States upon the conclusion of his/her hunting or sporting activity.

I went through this with the BATF recently, when I wanted some stuff NP3'd.

The State Department told me that it did nbot concern them, and that I should refer to BATF and HS. The HS agents told me the same thing.

The BATF agents i spoke with admitted that there was a black hole between the 6NIA and actual import/export. The gist of my conversations (nothing in writing), was that it was legal to send a firearm to an American gunsmith for repair/modification, but they were unsure of exactly how I should handle the actual transport.

The unknown agents are wrong, there is no 'black hole'...

It is legal after the required import/export paperwork has been approved and permission to ship has been given.
