Henry Big Boy for hunting?

A friend of mine bought a Henry Big Boy .44 mag as his first(of his own) riffle this year. I was telling him about the day of hunting we had had and he had expressed some intrest in going whitetail hunting again. The question he had was can he use his Henry being it has a ten shot capacity? Does he have to plug it some how? Thanks for the help:)
 
I believe the 5 round rule only applies to detachable clips.The only law for plugging a magazine would be if you were hunting migratory birds with a shotgun and it is a 3 shot max regardless if your mag was detachable or not.
 
Here's what I found in the Ontario Hunting Regs.

Under the Criminal Code of Canada you cannot possess
any clip/magazine that holds more than five shots for a
semi-automatic centre fire rifle unless that clip/magazine
has been specifically exempted, pursuant to the Firearms
Regulations.

I'm looking in the online Criminal Code but haven't found anything yet

So the Garand Magazine may have been exempted
 
I remember reading something about magazine capacity in the FAQ section. It was explained very well, but remember certain hunting regs differ....
 
Ah... and one must not forget the classic Lee-Enfield with it's 10 shot removable magazine. Fully legal. I'm heading out with mine in the morning looking for some whitetail and maybe a yote or two. It's a little heavier with 10 rounds in the magazine but I sure would feel stupid if I ran out.... so 10 it is... well, ok, 9 as I did indeed use one on a mulie a few weeks back and didn't feel the need to replenish the supply.

1. Hunting regulations vary between provinces. The province you are hunting in sets the regulations for hunting in that province, including what makes a firearm legal for hunting there and what makes it illegal for hunting there. In some provinces this includes magazine capacity. You should check the provincial regulations and local bylaws for the area you are going to hunt. If you can't be bothered to do that, you should always use a restricted firearm when hunting, because if you tell the conservation officers or police you asked on an internet forum and some guy who lives in another jurisdiction told you it's o.k., they'll understand and let you off. :rolleyes:

2. Federal firearms regulations on magazine capacity only apply to semi-auto firearms and have nothing to do with hunting. Bolt action rifles, including Lee Enfields are not "exempted" from the magazine capacity regulation, because the magazine capacity regulation never applied to them in the first place. The exemptions for magazine capacity mentioned in the regulation of semi-auto rifles include the Garand M1 because it needs its en bloc clips to load its internal magazine and the standard clip is eight rounds; and they include the Lee Enfield magazine because there exists an experimental semi-auto conversion of a Lee Enfield so the magazine could otherwise be classifed as a prohibited device.

Many appologies for wasting evreyones time, but I honestly done a search before posting the question but came up with nothing to give me an answer. I do check the regs for many things I am unclear of. As I mentioned earlier this is not a situation that really applied to myself being that the only non restricted with more than a 5 shot capacity I own is my M-1 and I do not hunt with it. I thought the mag capicity restriction applied to all hunting riffles, and did not realize it was just semis. I do, how ever , quite enjoy the bear defense discusions.
