HR problems

I recently got a HR rifle in 22 hornet. If the barrel is not pointed up, it will not #### the hammer. Even if the barrel is level, as in, in my rest, it won't ####. If I point the barrel up even slightly, it'll #### fine, has anyone ever had this issue? How can I fix this? Or should it be right off to a smith?0

Off to the gunsmith with your H&R, it has a broken spring.
