I’m looking at a savage accustock and magazine that was removed from a savage 110 short action
I can get it cheap but its in the states, i live close to the border so distance isn’t an issue , can I legally cross with it without getting an export permit ??
Ive looked online but its not clear to me , from what i can tell if its less than 100 i should be ok ??
Thanks

If you get caught on the American side you will be in trouble. I believe it's a large fine, possible jail time and a ban from entering the us

If the US side can mail it to you without export/import paperwork then you are able to also take possession of it in the US and leave the US with it...

If export/import paperwork is needed you can't do it without that paperwork...

Well exactly but how do I find out if I need an export permit? All
I can find online is if it’s less than 100 dollars it’s ok , is this the case ?if I purchase it I’m planning on just driving across the border and picking it up from a postal outlet.

NO YOU CANNOT.

In short, under ITAR the exporter, i.e. the person carrying or shipping firearm parts out of the US, must have a permit REGARDLESS OF the COST of the shipment.

The $500 exemption only applies to a Permitted exporter, not just any US citizen and certainly not to a Canadian visiting the US.

The $500 exemption only means that a Permitted exporter doesn't have to file a written export license (the person/company needs a Permit, AND every single shipment (except for exemptions) needs a license) but the exporter still needs a Permit.

All that said and done, you may get away with bringing it back across the border but that doesn't mean it's legal in any way.

Best of luck one way or another.

Ok that’s a little clearer , it’s hard to navigate all these different rules and exceptions, interestingly enough I have ordered thousands of dollars worth of muzzleloader parts , barrels etc through the mail and never had a problem whatsoever.

well put and indeed correct

True that $500 exemption is only good for licensed exporter to use, also, shipment requires AES filing to use the $500 exemption.

Does anyone know if its possible for a private US citizen to export ITAR items if they complete the paperwork?

Currently they would have to register as an exporter with the US DOS and pay the $2500 registration fee. Pretty sure that would have to be a company, and not an individual.

How about importing a stock from New Zealand? The company I spoke to said no problem 200 shipping via UPS..do we have any import regulations in Canada?

That would be no problem at all unless New Zealand has some sort of export restrictions as well. You'll have to research what their laws are.

Importing into Canada shouldn't be a problem. Getting it out of the source country requires abiding by their laws too.

The exporter would have to register with the US Dept of State or the US Dept of Commerce including paying a fair chunk of change for their export license (something like $5,000 US a year if I recall correctly). There is no exemption or loop hole for private citizens for the US Export Regulations.

I think there is a one time way for US citizens to export firearms out of the US, and I expect it would include parts, and that is to allow individuals to move out of the US and take their guns with them. This exemption cannot be used to send guns out of the country. I'm not sure how this is to be implemented under the shift of some responsibilities from Dept of State to Dept of Commerce.

I followed-up with DoC after March 9th just to see if anything had changed that would allow for a low-cap 22 mag to be shipped out of the states without a license - short answer: no.

Individuals residing in the US can apply for a private license to export items such as my 22 mag but I have no idea what hoops or costs are now involved.

In speaking with the export counsellor I did learn that firearms manufactured from 1890 to 1898, and reproductions thereof, don’t require export licenses, nor do bayonets... Not that it was at all helpful hahaha.
