It twist locks in place?I didn't get to spend more than a couple minutes looking at it after unpacking the upper before having to head to vancouver for the night. Though ii was extremely happy with how the upper and lower mated. Tight with no play what so ever from what I can tell
 
That barrel nut looks like it's had a "tooth" ground or filed off next to the gas tube and some of the other teeth look kinda mangled. Did the seller assemble this himself?
 
The one tooth next to the gas tube is indeed ground down. But the teeth look worse in the photo than they are in person. It was assembled by the seller. The whole upper is like new condition. Does the twist go to the right or left of your looking at it from above?
 
Slide it on like in your first pic and twist "left" to line up the rails. The little tab on the handguard should end up flush against the side of the upper.

I'd put a new barrel nut on. With the tooth missing on that side it is possible for the nut to loosen. That may not happen, but it is possible. If you replace it, be sure to get a NEA nut as it's slightly different from standard and necessary to get proper fit of the handguard against the upper.
