IR scopes/optics

Hey, fellas. I am new to the thread and only really dropped in because I cannot find an answer to my (I thought) very simple question anywhere else. I am aware of the diferance between light intensifiers, thermal and IR and also of passive vs active IR but I have been under the impression all this time that passive IR scopes or binos were unlawful for civilians due to their obvious use of watching someone without them knowing whereas the active is immediately identifiable if you have your own. I guess it seemed to me like evening out the playing field. I have nothing to back this up and it is looking like I have been wrong all this time but I wanted to see if any of you guys could shed some light on the subject.

AFAIK there are no Canadian laws prohibiting the possession of any IR/thermal/night vision/etc. optics, but often these items are heavily regulated by export controls and end user certificates. So it's not that we cannot possess them, it's that they're exceedingly expensive and hard to find legally (at least for the latest gen stuff).

So, there's no differentiating between passive and active IR optics legally? I shouldn't be surprised but somehow I am.
