is it illegal to spot light deers?

I should have mentioned in my earlier post, that if you were doing this during hunting season a CO could reasonably charge you on the basis that you are locating game at night. Ontario law prohibits the use of anything that projects a beam of light while hunting. If it is unreasonable to believe that you are attempting to locate game and are simply viewing for pleasure then I really doubt you'd have a problem.
 
.... If you're "FIRST NATIONS" Hunting for Food/Ceremonial purposes, a Judge on Vancouver ruled it was OK (Provincial Court ) and be damned with the safety issues. Otherwise it's definitely a NO No to Pit Lamp. Just illuminating for the purpose of taking Photographs, would be a challenge to convict, if done quickly and without undue "stress " on the Animal. .... David K

IIRC natives in NS were also given the greenlight to jacklight deer, moose, etc...and commercially fish for lobster, without a license. Happened several years ago and was supposedly covered under "traditional" hunting rights.
 
Read your MB hunting regs. This is how 'hunting is defined in MB.
"The Wildlife Act defines “hunting” as chasing, driving, flushing,
attracting, pursuing, worrying, following after or on the trail of,
searching for, shooting at, stalking or lying in wait for wildlife,
whether or not the wildlife is then or subsequently captured,
killed, taken or wounded..."

The thing to consider here is the intention of the individual being referred to. There are nighttime buggy tours here to photograph polar bears after dark, and because there is no intention to injure or kill the bears it is a legal activity. Same goes for around the buggy camps. There is no intention to kill the bears, so the activity is legal and accepted. One must assume what applies in the case of one wild animal would apply in another, and the wording of the regulations in the hunting brochure is with the taking of the game animal in mind. IMHO, photographers would be given a pass.
 
Why not just quit pissin' into the wind ?

If you're not out in some field jerkin' around with lights, you won't
get into any trouble ( well, not for jack lighting deer anyway, I'm sure
you'll find something else though ! )

"Cruise Night - 4 a.m." ... find a real hobby, grow up a little, get a life, before you and/or your old man gets you both into some real s**t .
