This has been discussed a few times before, but I forget what was concluded. I know we can possess a Garand as its 8 round capacity is specifically excluded from prohibition. The other part refers to Provincial Wildlife laws. Alberta (anyways) seems to prohibit using a semi-auto with a mag capacity greater than 5 rounds.
The Alberta Wildlife Act states:
"It is unlawful to set out, use or employ any of the following items for the purpose of hunting big game:
- an auto-loading firearm that has the capacity to hold more than 5 cartridges in the magazine."
Does that mean that the Garand can't be used, or that you can, but must employ a 5 round clip? All Garands have the capacity to hold up to 8 rounds depending on the Enbloc in use. It would seem illegal to hunt with a Garand and have access to an 8 round Enbloc while doing so.
What do the other provinces say?
Ontario allows the full 8 rounds for hunting.
That is correct. You don't need the 5 rd Garand clips for hunting in Ontario. This is quoted from the Ontario Hunting regs.
Under the Criminal Code of Canada you cannot possess
any clip/magazine that holds more than five shots for a
semi-automatic centre fire rifle unless that clip/magazine
has been specifically exempted, pursuant to the Firearms
Regulations.
Since the Garand is exempted under the firearm regulations, you are ok to use the full 8 rd capacity of the Garand.
Ontario allows the full 8 rounds for hunting.
You must plug a semi-automatic or repeating shotgun so
that it will not hold more than a total of three shells in the
chamber and magazine combined.
Under the Criminal Code of Canada you cannot possess
any clip/magazine that holds more than five shots for a
semi-automatic centre fire rifle unless that clip/magazine

Not the same for all provinces--Sask requires 5 shot as far as I know.
