Marlin 39A accuracy

I just got a new 39A in the mail from SIR and took it shooting, but upon returning home and cleaning it I noticed a dent right on the crown. I shot it agian after consulting with the gunsmith below at 50 yards with a variety of ammo and averaged 1.35'' with a scope the largest group was 2'' and the smallest .87''. I called SIR and they said they would not exchange a gun that had been fired, and told me to call the Marlin repair gunsmith for Canada, he was very helpful but said to take it out any try it and see if it shot under 3''. Now 3'' at 50 seems VERY unacceptable to me, and the accuarcy I tested above did not overly impress me as I heard these were very accurate guns, but I will admit that the scope used was a 3-9x40 simmons RIFLE scope so the paralax was bad at the 25 and 50yard, but is this acceptable?
 
If your gun has a heavy trigger pull like the other new Marlin's have you did surprisingly well.

SIR won't take back a gun that had been fired? With customer support like that they're going to lose a lot of business. Wouldn't the gun already likely been test fired at the factory? So you buy a used military rifle from them and you notice it's rusty or damaged. Will they say sorry it's already been fired in a war or whatever and not take it back? I can see if someone ran some hot reloads through a centerfire that could be a different story but it's a rimfire!
 
Yes, to be quite honest I was very disapointed with SIR and will probably not buy from them again. I find that policy on returns/exchanges very poor, especialy when you are purchasing sight unseen. The gun itself is very well built and I find the trigger to be pretty good with no creep and not overly heavy, my only complaint would be the dent on the crown and that the action is somewhat stiff, but I'm sure that will smooth out after a few more range sessions.
 
How bad is the "bump" on the crown? You (or your favorite gunsmith) could probably clean it up with a ball bearing and some compound.

I'm not sure what your expectations were, and what your shooting experience is, but 1.35" groups at 50Y with a lever gun is not bad at all...
(I'm sure many guys will be claiming 1/4" group, any time, all the time... but these are one shot groups, so they don't really count ;) )

What kind of set up were you using?
Was the gun clamp down in any way?
How was the temparature, any breeze?

Mine had quite a bad trigger - now no creep and breaks cleanly at 2-3/4 lbs pull. I would call Marlin and see what they have to say.

I bought mine from SIR too and your story gives me pause about the next purchase. OTOH, I thoroughly inspect every gun I get in the mail and wouldn't accept anything less than perfect for a new gun.
 
Marlin accuracy ?

I have 2 Marlin 39's ( as & mountie ) both are capable of very good accuracy well beyond 50 yards , I am using Remington "yellowjacket" out of them , but Federal shoot great too. You should get a gunsmith to look at it , and I thank you for the heads up on SIR .Good luck Joe
