Marlin1897 texan "A bummer"

Got a marlin 1897 texan , have had a lot of ejection problems so I sent it to the marlin gunsmith in Quebec. They emailed me today and said it has headspace issues and they couldn't fix it. said they would replace it. this model isn't made any more and I already have a 39a (that god a 1978 model , Works perfect)the only one they have that is similar to the 1897 texan is the 1894 cowboy , 20" octogan barrel strait grip and square back lever loop.What would you do if you were in my predicament??

head spacing?. is this gun new?. if not get a second opinion. this is the main reason
iam going to buy a older one. with all the new 39 problems lately the old one's are
probably going to double in price, damnit!!!!.

Gravel agency emailed me back today and said remington usa is going to send information to there gunsmith in quebec on how to attempt to fix it . I guess when I told them I wanted another octgon model inplace of my texan they changed there mind..............
