Conservation Service says Xiao's fine may be the largest for hunting moose out of season

A Vancouver man has been found guilty of shooting a bull moose out of season in the back country near Merritt, B.C., leading to costly fines.

"We're going to pull out the stops to investigate these things," said Conservation Officer Service inspector Dahl. "And when you do get caught it's going to be a serious penalty."

In 2013, two hunters spotted Xin Yue Xiao, 49, and a companion trying to load the carcass of a bull moose into the back of a pickup truck.

It was out of season to shoot bull moose, so the hunters took down their licence plate and called the conservation service.

This week, a provincial court judge found Xiao guilty of poaching the moose out of season and fined him close to $8,000.

But the largest financial hit comes from the civil forfeiture of the 2013 Ford Raptor truck he was driving.

Dahl said it's probably the most expensive moose ever shot in B.C.

"I don't know of a single case where anybody was sanctioned ... in the neighbourhood of $37,000."

My immediate thought was that $8000 wasn't enough....then I got to the part about the truck confiscation. NICE!
 
berger, the truck and guns if I understood another article I read will be returned once they pony up the 8k fine.
I can not find that story as it has some quotes from the two guys who initially spotted these to putz's.
Red mist, the suspension will likely become three years as they will not legally be able two buy one till after the conviction date.
CC and the Judge did a good job , but could have done a little better, but this is a measured conviction.
The next guys might not be so lucky...

This is great news seeing these poachers getting slammed hard for their selfish acts!

The one issue I have with the forfeiture approach is if one poacher has a $1000 truck and a $200 gun and gets a $8000 fine he pays $9200. The next example the poacher has a $40,000 truck pulling a $5,000 trailer loaded up with $25,000 worth of ATV's and $10,000 worth of guns. Combined with his $8000 fine and forfeiture hes out $88,000 for the same crime. That doesn't seem like evenly applied justice...or did I miss something?

Perhaps Rob you meant to say he gets his stuff back if he pays the court 8 k not 80 k?

A Vancouver man has been fined thousands of dollars for killing a bull moose out of season and leaving the carcass to rot at the side of a logging road.

Xin Yue Xiao was found guilty in Kamloops provincial court this month of three violations of the B.C. Wildlife Act, two years after the moose was killed.

Charlie and Kyle Carusi, a pair of father-and-son deer hunters, found the carcass near Stump Lake, between Kamloops and Merritt, on Oct. 5, 2013. The dead animal had a strap around its neck, and appeared to have been dragged to the road from the treeline nearby, according to court documents. It hadn’t been gutted or field dressed, and was cold to the touch.

Less than an hour later, the father and son witnessed a silver Ford Raptor pickup backing up to the dead moose, and two men rigging up a hoist with a cable.

“This is very unusual because most hunters gut and field dress their kill as soon as possible to avoid the meat spoiling. Also, to load a whole moose into the back of this Ford Raptor, without field dressing, it would likely be a difficult task considering the size and weight of the moose,” Judge Christopher Cleaveley wrote in his decision.

“This suggests to me either inexperience on the part of the hunters, someone in a rush, or both.”

Kyle Carusi asked the two men if they had shot the moose, and one of them replied that he had, but seemed reluctant to provide any more details. The Carusis wrote down the licence plate number of the truck, drove away and called the Conservation Officer Service.

When conservation officers arrived on the scene later the same day, the carcass was still there.

Officers tracked Xiao to his home in Vancouver, where they seized his truck. A second man, Wei Guo Li, was also charged in the illegal killing, but prosecutors were unable to prove that he was the other hunter and he was acquitted of all charges.

Xiao was fined a total of $3,738 and ordered to donate $4,000 to the Habitat Conservation Trust Foundation. He’s now prohibited from hunting in B.C. for two years.

His truck was also seized by the provincial civil forfeiture office, and he was forced to give up his two rifles.

From my understanding his possessions will be returned when the fines are paid.
The hunting lic. suspension will not allow him to buy one legally until after the conviction date thus being the third hunting season....

Donating money to the Conservation fund is an interesting approach. Is this a normal procedure? Nice move by the judge at any rate. The two year suspension of hunting privileges does not seem long enough. Are there limits as to the fines the judge can impose in poaching cases? Good on the Carusi's for their due diligence.
 
The hunting ban is a bit of a strange penalty in this situation. Although it prevents him from hunting legally...the poacher has already clearly shown he does not care about hunting regulations.

Kind of like the criminal who obtains a gun illegally, uses it in a crime and gets caught, and one of the penalties is that he/she can no longer obtain firearms legally for two years.

I guess it has to be included. Fortunately there are the financial penalties as well.
 
The fellas that reported him should get free licenses for a year and automatic get that slot in any license draws. The sooner every poacher is cleared from the woods the better.
 
The fellows who reported him shouldn't have their names splashed all over the news for down the road revenge vandalism after the smoke settles.Harold
 
The two year suspension could ultimately be a snare for the poach.
If he crosses that line again, contempt of court may bring the hammer
down a tad heavier.
Maybe time behind bars to think about the carelessness they chose to
poor Mah Earth.
