MRA / SBI bolt action builds - question on OAL

Hi guys,

I should know this but wanted to get some feedback. With the popularity of conversions from semi to bolt operated rifles using AR bits, what are the OAL requirements of BOLT guns that are assembled with Exiating AR parts?

My understanding that the 660mm OAL requirement applies to “shortened” barrels. And min 18.6” for semi auto firearms.

From NFA:

CC s. 84(1) “restricted firearm” (b): If a firearm has a barrel length less than 18.5″/470mm AND is centrefire AND is semi-automatic, that combination forces the firearm into the “restricted firearm” class. In such a case, IT DOES NOT MATTER HOW THE BARREL ARRIVED AT THAT LENGTH. The rule is the same regardless of how it ARRIVED at the too-short length — but note carefully that this rule is overridden by the rule just below if the barrel is SHORTENED BY CUTTING IT DOWN OR BY SUBSTITUTION to less than 18″/457mm. That is a case of “the specific overrides the general.”

If a SBI or MRA build has a factory barrel less than 18.6” AND has a folding stock it could very well be under the 660mm OAL requirement. However it appears that the over all length rule doesn’t apply.

Again from NFA:

CC s. 84(1) “prohibited firearm” (b): This is another clause of the same law — the one cited immediately above — and it applies in the same way. If the firearm ARRIVES at the “less than 26″/660mm in overall length” condition by “sawing, cutting” etc., then it is forced into the “prohibited firearm” class. If it left the factory at that too-short length, the limit does NOT apply. It is non-restricted, UNLESS it is semi-automatic AND centrefire.

26" overall applies to be NR, there are some exceptions/nuances from factory, but best to keep it >26".
Don't cut a barrel below 18", but a factory made shorter barrel is ok as long as greater than 106mm/4.17".
A folding stock can be used so long as it is still >26" OAL when capable of firing. So in this case, if you used a folding stock you would have to get longer than 26" folded.

Also, maybe don't take it from the NFA. Look at the Firearms Act and the Criminal Code.

Any barrel length is fine, but if keep the thing over 26” to avoid any issues. Legally any length should be fine, but we all know our law enforcement and “justice” system will do everything in their power to ruin your life, with (and especially without) good reason.
 
In practice, no one knows as a court would have to decide. I believe that you can go under 26.1” OAL with a fixed stock. I believe they are no different than a mare’s leg. But, you’re assembling it and not a manufacturer.

It’s NOT Semi auto.
It is a manually operated (bolt) centre fire rifle
The barrel length (ie: 12” or 16”) would be NR legal as it’s a “factory length”

The overall length appears to be specific to: semi auto, centre fire rifles. Or rifles that were “shortened” (ie: sawed off)

I’ve read the CC and other guidance but considering that this wasn’t “from a factory”. It just bewilders me.
I would love to have a folding stock on one of my MRA or SBI builds (but when folded). The over all length is less than 26” / 660mm

It appears that the law never anticipated that there are rifles that would not be “from factory”.

Folder won't work on the MRA as it still uses the buffer tube/spring. Might be some kind of contraption out there I'm not aware of.

Factory rifle is the receiver. Everything else are factory parts. Don't see any issue there.
 
The Law Tactical or copies would probably work. Might need some fabrication to the bolt carrier or the buffer as those rely on extensions off of the AR bolt carrier.
 
I also have the SBI LPC and it doesn’t use a buffer or spring. It’s completely manual and doesn’t require a buffer at all.
There are so many types of folders available that would make my 14.5” bolt gun far more compact to transport and store.

However once I add a folding stock the overall length is less that 660mm.
