I would like to see a legal opinion on this but to me it seems to be aimed at unlawful killing. Shooting birds on a game farm would seem to be a lawful use in my uneducated layman's opinion.

Boo - NO...the world is run by lawyers who have people to read the details for them:mad:

I participate in Springer Spaniel field trials and the above legislation would make our trials illegal. Spaniel trials have been held in Canada since the 1920's and should continue for many more generations. This is an attack by anti-hunters and must be stopped! If passed, you know they won't stop there! Fire up those keyboards and send an e-mail, today!

I have to agree with Goose, can someone tell me what the changes are from the existing Criminal Code.

I read everything on the Link and it appears to me that everything people have a problem with is already part of the current Crimal Code (i.e. baiting, releasing of trapped birds for shooting, etc).

The term "baiting" appears to have a double meaning in the context of the legislation, the same as cockpit. I think they use "baiting" to describe the act of enticing or teasing two animals to fight. The release of live birds appears to apply to a situation where someone shoots a bird that is immediately released from a cage/trap. Is this what they do at Dog Trials, do you shoot birds that are immediately released from a cage, I don't know. Again both of these are already in the current Ciminal Code from what I read.


One section I found interesting was this one:
444. (1) Every one commits an offence who wilfully
(a) kills, maims, wounds, poisons or injures cattle

Does this mean the money I spent on my hamburger last night is going to support these organized criminals known as farmers?

So I am with Goose, but I read the material and still don't understand the main issue with it?

We all know that game farms and dog trials are all legit things to do with animals for the most part. No, trials do not involve shooting birds that were released from traps. They are pen raised birds yes, but they are taken out and planted in the field and then it is the dogs job to flush to in some cases point the bird out. If and when it flies, then it is shot, if the gunner can hit it. In my estimation they do have a chance to flee or fly away just like a wild bird has. People who do not understand what is going on see that as cruelty and the way this law reads I feel some people could interpret those things as cruel and push the issue. That is when it gets pushed to our courts systems and costs us alot of money, because of interpretation. I agree with Kenny G, the old cow that I had that I butchered last month should get me some jail time I guess. Are people who buy meat at the store supporting crime? I think not!! Let's be realistic cows are not raised because they are beautiful, smart animals! They are raised to eat. That being said I think that part is put in there to prevent people from driving by a heard and shooting one in the a** and driving away. I dont think it would be a bad idea to email the MP and remind him though!!
 
Thats what I thought about the dog trials. I have seen them on TV but never had the opportunity to attend one in person.

I figured the Section 444 item was to protect farmers and cattle from the type of situation you discribed but I still don't know why it is worded the way it is. I am sure a lawyer could give us a 1 hour lecture, for a few hundred bucks, on the difference between killing (as stated in the Criminal Code) and butchering.

I guess my point was to illustrate that the Law aleady contains the main points most of the folks on this tread took exception too (unless I misread the material). If there is a real threat to hunters in the proposed changes let me know and I will send a letter, otherwise I would prefer the MP stay focused on killing the Registry.
