Newbie Question: PAL Applcation, Pending"Obstruction" Charge

I have a lawyer for the criminal charge-- as I only practice business/international law-- but he doesn't know anything about PAL applications.

So, you "consult in legal services", an encounter with law enforcement results in obstruction charges, and you think it is a good idea to get your legal advice from an internet forum about shooting and hunting???

Do NOT depend on what you learn here. Find a lawyer who knows his stuff. Start thinking with the head that wears hats.

Best thing to do is to answer thruthfully in the application and there shouldn't be a problem, they'll call you you can explain to them calmly what happened.
I've seen worse cases where peoples had their license any ways. Having a rough brush with the authorities is not that uncommon, they can show up at the worst times ;)
Like you said it didn't go to court charges were probably dropped. I don't see a problem so just fill your app. and send it in you'll get a call

I'm a bit confused. Is this charge new or old? Did it get dropped? If it's still pending, it's likely going to hold up your application. Kobs said it; Be truthful and talk to them on the phone. You can talk to a firearms lawyer (there's a few really good ones that may do consultations for a fee) and see if you can do both at the same time but for now I'd say take care of the charges pending.

I know of people who have had drug possession convictions get approved for PALs after a couple phone conversations. Humans will screw up, it's not like you're running for prime minister here.

I am not depending on anything and you really should not make stupid assumptions about what I am doing. It is reasonable for me to seek the experiences of other people who are familiar with the PAL process. I found your reply a complete waste of pixels.

You can pretty much bet that a charge of obstructing a peace officer is not just going to disappear. Your lawyer should be trying to win that charge, not worry about firearm laws.

I didn't think I was in a criminal law forum. My counsel and I are handling the criminal charge; no one is "worried" about firearms laws. I am trying to get soundings from Canadian PAL licensees on their experiences which is proving to be a pointless exercise.

Thanks for your advice. However, I didn't "screw up".

It hasn't gone to court yet. It's in limbo, not dropped. Court date probably wont be set until 2015 if Crown Counsel doesn't stay.

Could you tell me what worst cases you've seen?

wow man, you've just gone and offended most of the forum with your antics... You come off as an elitist who thinks he's better than everyone else who's being asked for their advice. Just some more advice, when you come onto a forum as a complete newbie, and ask for advice, don't crap on the guys who are giving it to you...

I was recently denied my PAL, after a year long wait. I had a pending charge, and the firearms office said I must wait until any pending charges are cleared. My charge was withdrawn, and I was still denied my PAL due to the fact it was within the last 5 years. You will likely get approved though, as long as the rest of your history is clean. I'm just thinking you might have to wait a while until the court case is over. But maybe not. Each case is different I've noticed.
