Just checked the 3 magazines that came with my new M&P 9, and yes, one only holds 9, while the other two hold ten...why the difference?

Check this link, these are 17rd mags but of the 5 10's that I have, there are 2 different sizes of springs. 3 long springs and the other 2 are shorter.

The spring may be really stiff and will allow 10 after some use... if it's pinned incorrectly I'd send it back for an exchange.

They aren't pinned, they're factory 10 round mags. On the '9' rounder if you can't get a 10th round in with an Uplula, sand down the follower leg until you can - don't overdo it though. Once you get the tenth round in, leave the mag loaded for a week or two between shooting sessions, it'll break in and work fine.
