online gun purchase - ATT question

You absolutely DO NOT NEED AN ATT to pick up a PARCEL from the post office. PERIOD. END OF STORY.

Prove it. There are 3 acts of parliament and the CFC that don't agree.

Fair enough...but then he better put the package on the counter, open it up, PROVE & ACTS the firearm in full view of everyone, and apply secure locking devices to both the gun and non-transparent case.

After all, we don't want to break to break the criminal code.

Serious question here: How do we pick up a restricted firearm (knowingly) without breaking any of the transport laws?

Thats the problem, you cant follow the law 100%.

At least if you get an SATT and god forbid something happens, your lawyer can argue that you were attempting to remain in compliance of the law. Where the "its a package" way just adds charges.

Phoned CFC this afternoon to see if transfer was completed on my new restricted coming from Reliable in Vancouver, which it was. Lady asked if I wanted to pick it up today.........:mad:

I explained to her I lived in AB and firearm coming from Vancouver. She said ok, but make sure you phone in and get an ATT if I am picking up the firearm from the post office. Have the street address of the post office ready and they will issue ATT.........

No one knows whats in the package, all anyone can do is assume........
 
The backroom laywers are at it again I see.

Bottom line as far as I am concerned it this - YOU know what it is, it is being sent signature required, you are signing for it, so get the freaking ATT FFS !!!
All you have to do is call and get the number and write it down !!

Lets see: If you got stopped or were in a accident...
1)You would have a hard time convincing a judge you didnt know what it was...
2)You would spent $2K min on a lawyer to be able to convince that judge....

OR, you can call and get an ATT....for free.....and then you know you wont have any problems....

Hmmm....I know this is a hard decision for a lot of guys on this forum.......

Hard to argue with that. Thank you, by the way. I may be getting my first pistol soon and this is pretty definitive reasoning.
 
I guess the moral of the story is....

Be at home when the mailman delivers!

I bought a tt-33 from one of the site sponcers last year. I checked the mail daily (we dont have home delivery here) and just about sh@t one day when i came home and my 13 year old says there was a parcel for you dad and hands me my pistal lol. No signature or questions just here ya go.

A) Im no backdoor lawyer.
B) A package in your name, completely covered with absolutley no indication of what is in the parcel, how do you know whats init?
C) I phoned CFC, talked to Darlene in the ATT (1-800#, 1 for english, 5 for ATT), and got my ST ATT emailed to me in 5 mins.....

Very easy, no hassel. Definatley the way to go!!!
 
no harm no foul unless you get caught then your ####ed. chances of getting caught probably very slim. i will just avoid the whole thing buying at my local gun dealer / gunsmith. the att should cover coming from the gunsmith. i hope... oh wait that would make sense so probably not.
 
If you get an ATT would you not have to ensure it has a trigger lock and transported In a locked container

You can reasonably assume that the individual who shipped the firearm has complied with the laws pertaining to shipping requirements. Worst case, you get pulled over, your ATT is checked, cop opens the sealed package, sees no trigger lock. Will you be charged -maybe?, convicted?, highly unlikely. You had no intent and made a reasonable assumption.

See, there's only 2 choices,--assume the shipper obeyed the law, or --assume the shipper disobeyed the law.

Which of these do you think a court would believe to be a reasonable assumption?

If you were to assume shipper lied to you ('cause for sure you were prudent enough to ask him how the gun was shipped) then, DON'T ACCEPT DELIVERY OR SIGN FOR IT111.
