Our skeet/trap fields border the city sewage lagoons, and because someone dumped something into a lagoon that wasn't allowed the lagoon has to be drained/filtered, and all of the contaminated sludge has to be dug out, and disposed of. This will go on 24/7 from roughly the end of April, through September, and with the workers and traffic that will be present during this time, our skeet/trap fields can't be used.

Well that sucks. Any idea what was dumped that has caused such an expensive issue? Lloyd has a skeet range open monday & thursday evenings that will be opening for the season in the next week or two.

Apparently a business had a permit to dump something in the lagoon, but they dumped something that wasn't allowed. Apparently, their insurance is now going to have to pay for all of the work. Meanwhile, we lose our ranges for about six months.

That's true but their customer has put you and a bunch of other people out of your recreational activity for the summer. I think a case could be made especially if there isn't another skeet range that you can use close by. The squeaky wheel gets the grease!

Or if that other skeet range nearby requires paying another membership fee to use it.

While the heavy equipment is nearby if you ever had plans of expanding or such now would be the time to get the dirt work done.

We are planning to expand our rifle range, but the approvals are not all done yet, and the dirt being removed is contaminated, so we can't have it for berms.

If we were a for profit business, we would definitely be looking for compensation, but being a non profit, showing a loss, won't be so easy.

Non-profit status shouldn't matter. If the club charges members for a round of skeet then the company's dumping has incurred a loss of income. Might be worth talking to a lawyer or to your own insurers.

income in = taxes out = non profit

no income in = taxes out = loss

The club will not suffer a loss this year, trap and skeet is only one of our disciplines at the range, and it isn't one that brings in considerable revenue. Now if we lost our rifle/handgun range, we would lose 75% of our members, and thousands from lost range rentals. If we lost our action pistol bays, we would lose 20% of our members, lost rental revenue, and $15k or so in lost revenue from holding matches. We don't rent out trap/skeet ranges, and don't host money making matches, and we operate them to break even, so we might at most lose less than 5% of our members, for a total loss of maybe $1500. It really wouldn't be worth much effort to try and recover such a small amount.

Have you sold any memberships that you'd need to refund?

We are a multi discipline facility, almost every skeet shooter uses the other ranges. When we lost the use of trap/skeet ranges for months previously while the city had lagoons dug out, nobody asked for a refund. And we shoot all year, and I don't know of anyone willing to give up the rest of the year, to get a refund.
