Hey guys this just makes me speachless.......tell me again what the hell is going on!!!

I just don't get it the tree huggers/envirotypes should be all over this condemming this type IMO unethical way of hunting, and the everyday hunter following the letter of the law gets a bad rap ever single fricken day. WTF!!!!

OTTAWA - A B.C. aboriginal band won the right to hunt at night in a split Supreme Court of Canada ruling on Thursday.

The dissenting team of judges in the 4-3 ruling chastised the majority for allowing a protected treaty right to trump public safety.

The decision overturned the convictions of two members of the Tsartlip Nation on Vancouver Island for hunting at night, a practice that is banned not only in British Columbia, but nationwide, on the grounds that it is dangerous to both hunters and the public.

Ivan Morris and Carl Olsen, who were caught a decade ago in a sting operation, successfully argued that they should be able to hunt with rifles in the dark, with the aid of a lamp, because their ancestors had engaged in the practice using torches and bows and arrows.

The majority of the Supreme Court ruled that treaty rights must be adapted to modern times and that “hunting with a rifle and ammunition is the current form of an evolving right whose origins were hunting with a bow and arrow.”

The majority disagreed with the minority that all night hunting is dangerous, and it should be up to the Crown to show it is a dangerous activity, rather than imposing a blanket ban.

“It applies without exception to the whole province, including the most northern regions where hours of daylight are limited in the winter months and populated areas are few and far between,” said the majority ruling, written by justices Marie Deschamps and Rosalie Abella.

In the dissenting decision, penned by Chief Justice Beverley McLachlin and Justice Morris Fish, they concluded that “public safety enjoys preeminent status in matters of this kind.”

The minority noted that courts have consistently found that night hunting “inherently involves an unacceptable and elevated risk to the public.”

The decision is the court’s first pronouncement on night hunting and it is the first victory for Morris and Olsen who, until Thursday, had lost their 10-year legal battle every step of the way.

No offence to anyone:
Now adays, they are no more of a traditional native, than you or I. If they want to hunt at night, they should hunt with hand crafted bows, and they should use replica torches. Until then, they should hunt during the day like the rest of us. I think that we should be able to hunt at night also because thousands of years ago, thats how my distant ancestors hunted dinosaurs.
 
It is this sh!t that p!sses me off to no end! what makes them anydiffrent them me? Maby the color of there skin? sounds kinda racise dont you think? I thought that every one was sapose to be equal. Guess that is a load of sh!t. Oh well they put in a little catch 22 they have to be doing it safely and it is up to the CO wether it is safe or not....

Face it guys, there isn't a single politician out there with the balls to put an end to this B.S. I looked at an actual treaty at a library and after each section the term " At the will of the Queen " appears. That translates to the government can change things. I firmly believe that treatied first nations people have the right to sustain themselves from the land but it sure as hell doesn't mean night lighting and shooting the hell out of everything.

Sustenance means food and not $50,000 tricked out 4X4's

Want their cake and eat it too! Methods of hunting evolved, only thanks to whitemans influence, so why not accept the rest of the package. Total BS! How can one help not be racist when these idiots bring it upon themselves.
 
it is disgusting. treaties should be done away with forever. the past is gone and now they all want gas powered vehicles and insulated houses, as far from traditional as it gets. we have been insulating our houses for as long as building design goes back. they want to live in the past, fine do it, but not in an insulated teepee, or with a remington rifle and 1,000,000 candle power light. i think that the times are getting very near where canadians are finally getting fed up with the whole situation and will put an end to it forever....... time to stop tip toeing around the chiefs every whine and just say NO
 
This is just plain scary!!!!

I was hunting an area where I would hunt right until dark this year and then had an hour walk back to camp I pulled a dumb guy and left my head lamp in the camper so I was walking by the moonlight sure enough along comes a pit lamper on the road I am walking on took a shot at something out the window as he came up the hill stopped for a minute then continued on I made a split descision and ran into the bush lay flat behind a stump and covered my eyesuntil he was well past. When I got up to where they had got out to check the ground there were beer cans everywhere. Pit lamping is dangerous there is no two ways about it.

This descision is just plain idiocy!
 
It is only a matter of time before somebody gets killed. I have heard from several people who live in rural areas where this goes on. People will get to a point where they will take the law into their own hands. All it will take is some cattlemans animal getting plugged by one of these so called hunters and the bullets will fly.

If any politicians are out there please put an end to this before it is too late.

Sorry for a second there I thought that there might still be a decent politician out there. My mistake.

I wonder if the judges in this case could be charged with promoting hatred against an identifiable group? It would be a fitting consequence for that decision:runaway: .
