That is correct. To qualify as an antique in the USA, a 38-55 must be made in 1898 or earlier. To qualify as an antique in Canada, a 38-55 must be made prior to 1898 and it must be single shot only.
However, you do have a nice, honest gun that has not been messed with in any significant way and it has a nice bore. You may regret selling it.
 
Not putting the gun down but did nobody else notice the mag tube has all the blue while the barrel is very patina? They generally faded to the same patina from what I have seen!

Is there anyone here that can give me a legitimate reason why our stupid ass government decides that if the gun is a repeater that it is no longer an antique? I've got guns here that are 113 years old (made 1896) but are not classed as antique. It just boggles the mind. I'd like to go back in time and be in the room when whoever decided this is there and slap him upside the head when he makes this law.
 
That mag tube does look a little too nice. I've seen the occasional tube with a bad dent. It is ppossible this one was replaced. The rest of the rifle looks original .... Dark wood is an indicator that it hasn't been touched ... crud in corner of join between barrel and receiver .... worn blue on barrel and receiver .... all possible indicators of originality. The dark blue mag tube is troubling, though. Hard to figure it out without actually handling the old rifle.

Thanks again guys, very helpful. The rifle hasn't grown on me quite enough to keep it. I respect it enough not to shoot the heck out of it so I'll sell her and do just that to something newer.
 
I had a close look at ther mg tube vs bbl. In reality it's not as different as that picture shows. I think a professional look at it would suggest the tube may be original. There are some patina "corners" on the tube. I wonder if someone felt they had to rub the bbl down at some point and may have even stopped. But definitely not a "parts gun", appears it hasn't been apart in decades.
 
I have a 38-55 rifle DOM 1906 , a 38-55 Saddle ring Carbine DOM 1909 and shoot them both regularly. It is a very nice big game (deer) caliber and was developed for target shooting originally. Many black powder and silhouette shooters still use this caliber today. Do not be afraid to use it...that is what the guns were made for. Shooting it will not harm it nor devalue it in any way.

$8 !! Then what in tarnation were we worrying about giving him a fair market value. At $8 he obviously wanted to move it.
