Question Regarding Dlask SMD12

Hey folks.

I am interested in purchasing one of those 8.5 Dlask shotguns.

But my question is..... I am now hearing that the SMD marked version is actually restricted now? and the 870 marked version is non restricted?

If I remember correctly, a while back on here I saw a fellow that bought the 8.5 870 version but it had a pistol grip butt stock on it?

Could somebody tell me that has recently "with in the last month or so" bought the SMD12 Dlask 8.5, if it is still non restricted, and if the pistol grip still comes with it.

Last question.

What if I purchased this and it, down the road became restricted with me only having a PAL for non-restricted, would it be grandfathered to me? or would I have to give it up?
Could somebody explain that to me if they are in the know. I'd greatly appreciate it :D

Ok,

I found the answers to my questions. I will cut and paste for those wondering the same.

Straight from Dlask.

This post is to provide information to all of you and to those who have purchased the Dlask Arms short-barreled shotgun. A dispute has arisen as to whether it is a non-restricted firearm or a restricted firearm. Similarly, the Dlask P.A.C. 5 (pump-action) Carbine is the focus of an identical dispute.

As it stand right now the DLASK modified Remington 870 with 8.5” and pistol grip is currently NON-restricted and only the SMD-12 marked receivers are restricted.

We are moving to have these matters brought into a court and ruled upon by a judge. The only person in Canada authorized to decide such questions is a judge sitting in a court of criminal law. This will be done by transferring a sample firearm of each type to David A. Tomlinson, National President of the National Firearms Association. Once an application to transfer each firearm as a non-restricted firearm has been made, the Registrar may issue a registration certificate, or refuse to issue a registration certificate. If it is refused, Mr. Tomlinson will commence a reference hearing, as it is his right under FA s. 74 and 75. In that way, a legal decision can be obtained.

It should be noted that the Registrar may not alter the wording on an application, as Mr. Kingsley Beattie established that point in a court of law a few years ago. The Registrar must deal with Mr. Tomlinson's application to register as it stands, and using only the words written on the application by Mr. Tomlinson.

All of our customers that received a shotgun which has "SMD-12" ENGRAVED ON LEFT SIDE OF RECEIVER should be aware that the firearm will be treated as restricted. All of you that have received shotgun engraved as such please contact us and we will exchange it for you with another Remington 870 in same configuration, with pistol grip and 8.5 barrel which is still treated as NON-restricted. We will exchange it for you for free and cover shipping cost in both ways.

Again for now, only the SMD12 (marked receiver) model shotgun is restricted. We will notify you if there will be a new FRT number issued in future, stating restricted status of the other Remington 870 shotguns (not marked SMD-12) that you purchased from us. If that happens, as per advice of our lawyer, it will be important to maintain non-restricted status until this issue is resolved in the court of law. That can be done by substituting the pistol grip stock with the full size stock. We will be supplying all of our customers with the full size stock FOR FREE AND WE WILL COVER THE SHIPPING COST.

We would like to thank Mr. Tomlinson for all his efforts including possibly representing us in court of law if required. He insisted that he wanted to do this FOR FREE and this is too big of an issue for Canadian firearms community, to be dropped. Dlask Arms will be covering all legal and court expenses.

Please understand that we are not in control over this, but we are doing everything that we can in order to positively resolve this issue.

We will, of course, keep you informed.


Guess I will pass on that ###y lil thing after all :(
