Mark - realizing that a lot is at stake for you guys - would it be beneficial to try to acquire the information from FN to pass along to the RCMP? From the email threads and FoI documents etc., that I've read, it sounds like FN is not responding to the RCMP and/or the RCMP does not have the necessary information to finalize its categorization. One would think that this information would be available somewhere?
Just because we don't constantly post details on what we've done over the past 2 years to facilitate the classification process doesn't mean that we haven't been doing what we can. We have in fact had repeated contact with FN Belgium, FN USA and the RCMP SFSS on the various issues raised during the past 2 years.
One problem area has been that the RCMP at one point asked FN for detals of "Proprietary Information" that FN USA could not legally release to them and FN Belgium was unwilling to release... especially given that the RCMP can't guarantee that the information wouldn't become public knowledge, (in the event of a FOI request for example).
Just because information is requested doesn't mean it's actually necessary, required or even legitimate to ask for... nor does it mean that the company involved is going to release the information for public distribution (which releasing it to the RCMP would be equivalent to).
As I recall, FN's first response to RCMP's request was that the information was available but required an NDA be in place prior to release... but I don't recall the RCMP ever agreeing to enter into an NDA to get the information released.
