Ok, I was having a couple wobbly pops on Thursday night and came up with this idea:
The objective is to legally have a 10 round magazine in a semi-automatic SKS using the current laws and RCMP rulings.
Here's how;
We all know that the SKS is a gas piston driven semi-auto rifle, which is restricted to 5 rnd magazine capacity under our current law. Manually-operated rifles do not have a magazine capacity limit.
To make a straight-pull SKS, one piston must be removed and the tube altered so that a piston can't be refitted back into the rifle. If one was to take a SKS, chop off about 1' of the piston, and weld the piston back into the tube, the SKS would then become a manually-operated straight-pull bolt action rifle - which does not have any magazine capacity limits under our current laws. This would be a permanent modification, and so I don't think we'd have any trouble under our current law.
A manufacturer would then be able to LEGALLY make 10 round SKS magazines for that specific firearm, provided they are marked on the magazine for that rifle, and then they could be sold to people who have regular SKS rifles, and legally used.
Just as the AIA 10 round magazines are legal, because they are designed for a manually-operated firearm, when used in a M-305, I think these magazines would be legal for use in a SKS.
