I have an sks on the way with a tapco mag my question is (and excuss my ignorance) can I shoot it at the range unpinned or am I going to get into trouble. As I said I don't know the law on semi auto mag capacity
So help don't hurt

If you have one that holds more than 5 rounds you go to jail. Doesn't matter if you use it or not, you're in possession of a prohibited device.

No. No you can't. It has to be pinned as well. If you are in possession of an SKS magazine that holds ten rounds, throw it away/have it pinned immediately.

Also, spend some time on the Canadian Firearm Program's website. You need a refresher before you find yourself in trouble.
 
All sks's I've bought have factory tens and all I've ever seen in stores and gun shows,factory ten so I don't know if your just trying to preach because as I said they come with tens and when they are pinned they advertise it to, all the rest are unpinned

I just went to the orangeville gun show and they were all factory ten unless they were doing it illegally?

I think you are confused. Not all SKSes have a huge rivet through the mag floor.

Factory 10's all should have a rivet or pin in them to limit them to 5. It's the law.
 
Yup. I bought two and they have factory integral attached mags and they are riveted so they can only fit 5 ends otherwise they are considered to be high capacity which makes them prohib
 
Well then I'm wrong but the guy at the show had balls because he showed me the unrivited mag and said it's legal haha gun shows gotta love em

It had a pin welded to the follower. It looks like an unmodified magazine externally and it does internally if you don't know what to look for but it's still limited to 5 rounds.

All centre fire semi-automatic firearms need to have their magazines limited to 5 rounds, external or internal. There are a few grandfathered exceptions, like the M1 Garand.

I strongly suggest you take the Canadian Firearms safety course by a qualified instructor who can teach you the basic laws.
 
I will tell you a "fictional" story, when I was brand new to firearms the second gun I bought was an unpinned 10 round SKS. It was purchased used locally and was registered. From taking my firearms safety coarse I knew that semi auto made were limited to ten rounds I also remember being told that there a certain exceptions for some surplus rifles with internal magazines. Being a registered firearm being sold in the buy&sell I made the mistake of thinking this was legal. This was back when we had the LGR and I called in the required transfer. Now when I did this before with my first gun, a bolt action .30-30 long rifle the RCMP asked me how many rounds fit in the magazine but for some lucky reason they did not ask me how many rounds fit in the semi auto SKS? If they did ask I could of been in a whole world of sh:!, with the mandatory minimum sentencing firearms offence laws. Shortly after I riveted the internal mag to 5 rounds after finding clarification on the law. This site is a great resource for anyone wanting to learn more about firearms and their laws.
