So I found a scope on eBay....

..problem is, the seller is in Pennsylvania and I'm near Toronto. It's a rare/older scope and one I've wanted for some time. This one is NIB. :( I think I know the answer to this, but is there any way for the seller to ship that thing up here, or has the Dept. of Homeland Security deemed every scope...including low power rimfire ones, to be a threat to the US?

Something tells me the answer is "yes"...and that I'm SOL.

Grasping at straws...but can a seller ship a used rifle scope? Didn't think any scopes could be shipped from the US.
 
I've never seen anything that exempted used scopes from the unlicenced export ban.I'd love to be enlightened on that with something more concrete than internet chatter.:D Mur
 
I may be wrong but from what I have experienced and checked into is that a person can privately sell and export a hunting scope.

I however do not have documentation about this or know where it exists.

The use of the term used sports optics from my understanding is what the description is when you ship something and it does seem to be proper.

And calling a rifle barrel a high pressure steel containment tube doesn't make export without proper paperwork legal either.

New, used, doesn't matter, rifle scopes are controlled by either State or Commerce, and require export documentation.

In addition to exporting with out the permits, filling out the declaration in a manner designed to deceive might not be appreciated by the good folks at DHS.

If you don't check with the correct people, ie, the ones who know the correct answers, then the answers are worse than wrong, they could get you into a LOT of trouble.

Exporting scopes is EXACTLY the same as exporting EVERYTHING firearms related. The SAME rules apply if you are exporting 1 piece of used brass, to a fully functional firearm. There is NO DIFFERENCE in the rules or PENALTIES.

Check with the US Department of State, or for shotguns, US Department of Commerce.
 
The tinfoil hats are all shiny here this morning :) . I doubt there are any Canadians languishing in a US prison for buying a scope from ebay. Worst case scenario is you don't receive it. However, I am not suggesting anyone do anything illegal.

Number one: I don't wear tinfoil........gives me a rash......;)

Number two: there have been fellow CGN'rs who have experienced the U.S. border checks and inspections. They have related that it is not a pleasant experience.Detained for 8 or so hours......looking at up to 30 days in jail........having vehicles seized......... and having all the items they bought seized

Number three: Concerning E-Bay purchases, you will have the item seized and your named flagged for future shipments or cross border excursions. You could look at being hassled/searched more thoroughly at the border or denied entry all together.

The seller is the one who would have the biggest problem.

If you are not sure if something is legal to do, please do not post advice.........

Apart from the risk of a Canadian having his name put on the watch list, for having been involved in an attempt to circumvent US contols of arms exports, there is also the US supplier.
The worst case scenario is the US supplier getting prosecuted. Like Midway, Ziess USA, etc. There is a long list of individuals and businesses who have been prosecuted. The penalties imposed have been nasty.
But what the hey - who cares about somebody on the US side of the line?
